Now a day the terms "Peoples republican" is a high profile. After the election results of the constituent assembly chairman and Prime Minister Prachanda announced from open theater that, if any political parties hesitate to declared democratic republic than we shall declared peoples republican. At that time chairman prachanda said that if Nepali congress and UML is not ready to do it people will declared peoples republican after that where will be a space for them we can say nothing . This is a clear massage to the people and others political parties that Maoist is not waiting for a long time they are ready to declared peoples republican as soon as possible.
Second time Maoist leader said about peoples republican as a goal of CPN-Maoist. Nepali congress is in opposition. Being in opposition so that any words spoken by Maoist without any clear understanding or quite knowledge, then they are ready to critic it ready to oppose it this is the same things happened which is spread out in the open market.
Why Nepali congress and UML are afraid from peoples republican what is mean by it. First we must know about it.
First of all peoples republican mean by republican for the people by the people and of the people. If it is for the peoples why we should afraid? If any one is in favor of the people, there are no chances to oppose it. Those who are in opposition of peoples republican, they might be in confusion; they have no knowledge of it. If they are in opposition by knowingly it is cleared that they are not in favor of peoples republican instead of peoples republican they wanted to set and established feudal republican bourgeois republican.
Second, we declared republican, but we don't have named it. Whether it is people's republican or Bihari republican we have to make it. Some people wanted to make it Bihari republican. In this favor most of the feudal and comprador burocratic capitalists are being in exercise. Masses of the people are in favor of peoples republican. So it is quite good debate but it should be in fair manner. Especially feudal and comprador and beurocratic capitalists are afraid about it they wanted to save their interest by making republican as Bihari one, instead of peoples republican. They wanted to save from people's democracy.
Third, people's republican is not a strange matters those who are not against the peoples interest, but those who are entirely against the peoples they must be afraid from it.
Fourth the aim of all types of communist party is only peoples republican. The ultimate goal of communist party is peoples republican there is no doubt .Including Maoist they believed on people's republicanism. Even the CPN UML and others communist parties also same in principle. But including UML why they are against it, this is a very important question. The goal of all communist parties is republican. Some one likes to say others aren't. That is another thing; reality is that they are all people's republicanisms. So it is untimely debated about it.
Fifth there is no doubt the goal of Maoist is peoples republican as others communist parties. But now days what is the fact we have to know. Fact is that we are just able to declare republican successfully. We have to consolidate it and on the basis of democratic republican pave the way for forward to peoples republican.
Debate has taken place knowingly or unknowingly. People's republican is not an agenda against the people it is favor to the people though they are agitating peoples against their own agenda peoples republican. So people should know the fact and they have to take side whatever for or against it. Without having full knowledge taking side is unjustifiable.
Some of them are propaganda has been spreader out peoples republican is one party communist dictatorship which is completely wrong massage. If any one have any confusion about it please see the documents of CPN Maoist. CPN Maoist has already taken decision of multy party competition there is no doubt. Maoist is the party who has review the whole communist history especially in 20th century. First half of the 20th century was in favor of communist regime but last half of the 20th century was against of communism they lost their regime . Even though communist didn't have reviewed it except The CPN-Maoist. They found that there was some mistake in communist regime which is lack of multiparty competition. So CPN-Maoist accepted that and ready to correct it and easily accepted it in their policy.
If capitalist revolution was completed by Nepali congress and other capitalists parties CPN-Maoist can engage in socialist revolution but capitalist parties are compromised with feudal monarchy so CPN-Maoist thought that, first we have to engaged in capitalist revolution against feudal monarchy and consolidation of democratic republican which is purely capitalism then on the basis of democratic republican it can be established socialism.
In conclusion we don't have any surprising from Maoist version and vision. Maoist vision certainly can be a pro people. First time they may be afire it after a while they would be assimilate in it .Election of constituent assembly,Republican, Federalism ,state restructuring and military intermigration all the issues were the same now turn is peoples republican. It would be happened in its time but now we are in the phase of consolidation of democratic republican. On the basis of it with due time we can have peoples republican.

१। देवकोटाजी ने।रा।बु।संगठनको चौथो राटि्रय सम्मेलनको महत्व वारे केहीवताईदिनुहुन्छ कि ?
क्रान्तिकारी माक्स्रवादी बुद्धिजीवीहरुको एकमात्र संगठन नेपाल राष्ट्रिय बुद्धिजीवी संगठनको चौथो राष्ट्रिय सम्मेलन सम्पन्न भएको छ । मुलुक अग्रगमन र प्रतिगमनको दोसाँधमा उभिएको वेला १० वर्षे जनयुद्धको जग र १२ वुदे समझदारीका आडमा सम्पन्न १९ दिने जनआन्दोलनवाट सिर्जीत नया स्थिति नेकपा माओवादी र सरकार वार्तामा वसेको अवस्थानेपालवाटै विश्वलाई शान्ति अग्रगमन र न्यायको सन्देश दिन लागिरहेका वखत नया विश्वको जन्म हुन लागेको अवस्था संसारभरीका उत्पीडित वर्ग जाति क्षेत्र िलंगले व्यग्रतापूर्ण प्रतिक्षा गरेका वखतहिमालयको काखवाट नया विश्व उदाउन लागिरहेको अवस्थावाट वट अतालिएर साम्राज्यवादी र विस्तारवादी शक्तिहरुले मुलुकलाई यथास्थितिमा वल्झउन तिनका वौद्धिकहरु त्जष्लप तबलप मार्फत हद दर्जाको कोशिश गरिरहेका वखत र संसार भरीकै क्रान्तिकारीहरुले यथास्थितिवादका विरुद्ध जमेर प्रतिरोध गरिरहेका वखत नेपालमा क्रान्तिकारी बुद्धिजीवीहरुको राष्ट्रिय सम्मेलन भव्यतम र उत्साहपूर्ण ढंग वाट सम्पन्न हुने कुराले ठूलो महत्व राखेको छ भन्ने लाग्दछ । साथै यो सम्मेलनको भव्यता र सहभागिता गुण र संख्या दुवै दृष्टिले उल्लेख्य र ऐतिहासिक रहेको छ जसले नेपाली क्रान्तिकारी बुद्धिजीवीहरुका काधमा ठूले दायीत्व पनि थपेकोछ यस मानेमा यो सम्मेलनको भारी महत्व छ ।
२। देबकोटाजी ने।रा।वु।sाे चौथो रा।स। द्वारा तपाईं गरिमामय अध्यक्ष पदमा निर्वाचित हुनु भएकोमा हाम्रो पत्रिका परिवार हार्दिक बधाई ज्ञापन गर्दछौं । रा।स।sाे महत्व र उपलब्धीबारे कसरी बुझिनुपर्छ भन्ने ठान्नुहुन्छ
सर्वप्रथमत वधाईकानिम्ति हार्दिक धन्यवाद छ निश्चितै रुपमा क्रान्तिकारी बैाद्धिकहरुको गौरवशाली संगठनको अध्यक्ष पदमा निर्वाचित हुने अवसर प्राप्त हुनु र त्यो जिम्मा राष्ट्रिय सम्मेलनले मलाई सुम्पिनु गौरवको विषय त हुदै हो यसले अहम दायित्व पनि सुम्पेकोछ भन्ने अर्थमा मैले लिएको छु । जहासम्म यसको महत्व र उपलव्धीको प्रश्न राख्नु भएको छ संक्षेपमा महत्वका वारेमा माथि वताई सकेको छु । उपलव्धीका वारेमा चर्चा गर्दा यो सम्मेलन लामो समयको अन्तराल पछि विल्कुल भिन्न र नया परिस्थितिमा राजधाीमा सम्पन्न भएको छ । देशैभरीकेा ४ जिल्लाका प्रतिनिधिहरु मौसमको खरावीका कारण यातायात अवरुद्ध भएका कारण र अन्य सानातिना प्राविधिक कारणले अनुपस्थित रहनु परेको अवस्थाले ७१ जिल्लाको प्रतिनिधित्व हुनु झण्डै एक हजार बौद्धिकहरुको जमघट हुनु यसका वाहय र रुप पक्षीय उपलव्धीका हुराहरु हुन भने सम्मेलनको सवैभन्दा महत्वपूर्ण उपलव्धी भनेको नेकपा माओवादीका अध्यक्षजनमुक्ति सेनाका सर्वोच्च कमाण्डर क। प्रचण्ड र नेकपा माओवादीका अर्का वरिष्ठ नेतासंयुक्त क्रान्तिकारी जनपरिषदका अध्यक्ष तथा संगठनकै संस्थापक संयोजक डा बाबुराम भटटराईको उपस्थिति र प्रशिक्षणमूलक सम्वोधनवाट प्रशिक्षित हुन पाउनु हो । २१ औं शताव्दीमा नेपाली भूमिवाट मालेमाको रक्ष विकास र प्रयोग गर्दे नेपाली विशिष्ठतामा क्रान्तिको मोडेल तयार गर्दै विश्वलाई नै अर्को नया विश्व सम्भव छ भन्ने सन्देश दिन लागिरहेको महान आन्दोलनका महानायकहरुवाटै प्रत्यक्ष रुपमा विचार भावना र अनुभूति सुन्नपाउनु यो सम्मेलनको अर्को महत्वको पाटो हो । त्यसै गरी यो सम्मेलनले हिमालयको काखवाट जन्मन लागेको नया विचार सहितको नया विश्वको रक्षा विकास र प्रयोग गर्दै नेपाली जनताको मुक्ति र प्रगतिको मार्गमा विना हिचकिचाहट दृढ विश्वासका साथ लाग्न ठूलो प्रेरणा यो सम्मेलनले दिएको छ । यो सम्मेलनको अर्को उपलव्धी भनेको एउटै सम्मेलनको हलवाट सम्मेलन उदघाटनदेखि समापन सम्म आई पुग्दा व्यक्तिवाद र कमाउ खाउ मोजमस्ती गर भन्ने उपभोक्तवादी नग्न संस्कृतिको विकासले चरमचुली नाघेका वखत सो संस्कृतिलाई चुनौति दिदै आफूलाई सर्वहाराकरण गर्ने प्रतिवद्धताकासाथ देश र जनताप्रतिको त्याग समर्पण र प्रतिवद्धता वाहेक अरु सवै कथित नामधारी सेवा ढोंग हुन भन्ने सावित गर्दै चार दर्जन बौद्धिक व्यक्तित्वहरु संगठनका निम्ति पूर्णकालिन हुन ईच्छुक रहेको घोषणा गुर्न अर्को एउटा बौद्धिक फाटकानिम्ति चुनौति पनि हो र नया संस्कृतिको निर्माण पनि हो जो एउटा नया संस्कृति निर्माणमा कोशे ढू।गा पनि सावित हुनेछ । समग्रमा सम्मेलनले भौतिक नैतिक र वोद्धिक उत्प्रेरणा थपेको छ । यस अर्थमा सम्मेलन भव्य र भारी उपलव्धीपूर्ण रह्यो भन्ने मेरो मात्रै नभएर िसंगो नव निर्वाचित केन्द्रिय समितिको ठहर रहेको छ ।
३। इतिहासको अन्त र विचारको अन्तको हल्ला चलिरहेको बेला नेपाली सर्वहारा आन्दोलनको सहयोगीको रुपमा तपाईहरु नयाँ विचारको विकासमा जुट्नुभएको छ आजको विश्वमा बौद्धिक आन्दोलनका प्रवृत्तिहरु र अन्तरविरोधहरुलाई कसरी विश्लेषण गरिरहनु भएको छ
साम्राज्यवाद र उत्तरआधुनिकतावादले विचारको अन्त र ईतिहासको अन्त भएको जस्ता विभ्रमहरु छर्दै सारा संसारलाई नै विल्कुल अर्थहिन उपभोक्तावादी लक्ष हिन गन्तव्य हिन दिशा तर्फ जसरी डोराउदै छ त्यसका विरुद्ध विचारको अन्त हैन विचारको थप विकास भएको छ विचारको विकासको थालनी सौभाग्यवश नेपालवौ भएको छ र नेपाली जनमुक्ति आन्दोलनकै अगुवाईमा भएको छ भन्ने सन्देश हामीले हाम्रै संगठन मार्फत विश्वलाई दिन पाउनु चानेचुने विषय होईन । यस गौरवपूर्ण घडिमा हामी नेपाली मुक्ति आन्दोलनको सहयोगी एवं सहभागीका रुपमा मालेमावादको रक्षा विकास र प्रयोग गर्दे नेपाली धर्तिमा २१ औं शताव्दीको क्राि तगर्ने विचारको भू्रर्णका रुपमा प्रचण्ड पथ लाई जन्माउदै सो रक्षा र विकास गर्दै विचारकै स्तरमा उठाउने अभियानमा सहभागी हुन पाउदा हामीले गौरव गर्नै पर्छ । यस्तो गौरवपूर्ण क्षणमा उभिएर विश्वमा वौद्धिक आन्दोलनका प्रवृत्तिहरुवारेमा चर्चा गर्दा विश्वका जनमुक्ति आन्दोलनहरु चाहे फ्रान्सेली क्रान्तिको कुरा होस वा वेलायतको राजतन्त्र विरोधी संघर्षका यमयक्रमहोस चिन रुस भियतनाम क्यूवा वा अन्य पूजीवादी र समाजवादी सवैखाले मुक्ति आन्दोलनमा वौद्धिकहरुको भूमिका उल्लेख्य रहेको मात्रै हैन वौद्धिक समुदायको सहभागिता विना कुनै पनि क्रन्ति सम्पनन हुन सक्दैन भन्ने पुष्टि गरिदिएको छ त्यसकारण वौद्धिक आन्दोलनले संसारका सवै जनमुक्ति आन्दोलनमा आफनो सहभागिताको हिस्सेदारीमा गौरव गर्ने हक छ । यति हुदा हुदै पनि बौद्धिक वक्तिहरु कार्यविभाजनका हिसावले मानसिक श्रम गर्ने भएका नाताले र बैद्धिकहरुको क्षमतालाई पूजीवादी साम्राज्यवादी र सामन्तवादीहरुले प्रयोग गर्ने खरिद गर्ने र तिनलाई प्रभाव पार्ने भएका हुनाले बौद्धिकहरु प्रतिकृयावादीको सेवामा वढि देखिनुको दोष आम वौद्धिकहरुले पनि खेप्नु पर्ने अवस्था छ । त्यसकारण बौद्धिक वा अवौद्धिक भनेर र्होइन वर्गिय हिसावले नै सोच्नु पर्ने हुन्छ । बौद्धिक हुनु नै अपराध हैन कि उसले आर्जन गरेको बुद्धि कहा र कसको सेवामा प्रयोग गरेको छ भन्ने कुरालाई नै मुख्य मापदण्ड वनाउनु पर्छ । यसरी हर्दा चाहे चिनको जापानी साम्राज्यवादको आक्रमण र उसको कथित राहत वितरणको वेला होस चाहे रुसको जारशाीको प्रलोभनको अगाडि बौद्धिकहरु कुनै संझौता नगरी दृढतापूर्वक प्रतिरोध गरेर कतिपय ख्यातिप्राप्त प्रोफेसरहरु वरु प्राण त्याग्न तयार भए कथित राहत स्वीकार्न पनि तयार रहेनन् ती उदाहरण मुक्ति आन्दोलनमा बैद्धिकहरुको भूमिका वारे मूल्यंाकन गर्ने महत्वपूर्ण आधारहरु हुन् । बौद्धिकहरुको कामको स्वरुप तिनको क्षमता तिनको विद्धताको समाजमा हुने माग र सोका आधारमा प्रतिकृयावादीहरुले खरिद गर्ने प्रवृत्ति समेतका आधारमा बैाद्धिकहरु स्वयं ढुलमुले वन्ने समाजिक तथा भौतिक परिवेशले विलासी वनाईदिनेमनमा क्रान्त्किो चाहनाका वावजुद पनि भौतिक परिवेशलाई चिरेर अगाडि वढीहाल्ने साहस यदाकदा कमि देखिने समेतका प्रबृत्तिहरु वौद्धिक समुदायमा देखिने गर्दछन् यसका विरुद्ध संघर्ष स्वयं वुद्धिजीवीहरुले नै गर्नु पर्छ । मजदुर बुद्धिजीवी वनने र बुद्धिजीवी मजदुर वनने प्रकृयालाई एकसाथ लगेर मात्रै आन्दोलनको हित हुन्छ भन्ने कुरा पनि वुझन पर्छ । यसरी हेर्दा क्रन्त्ाि विजय र। पराजय मध्यवर्ति तप्का कता लाग्छ भन्ने कुराले नै निर्धारण गर्छ बौद्धिक समुदाय यो वर्गको प्रतिनिधि पात्र हो त्यसो हुदा यो समुदायको आकर्षणमा नै क्रन्त्ािले विजय हासिल गर्छ भन्ने कुरालाई पनि ख्याल गरेर बौद्धिक समुदायको भूमिका र प्रवृतिका वारेमा आंकलन गर्न पर्छ ।
४। विगत अढाई सय वर्षदेखि एकात्मक सामन्ती हिन्दु राज्य बन्दै आएको नेपाललाई संघीय लोकतान्त्रिक गणतन्त्रको रुपमा पूर्नसंरचना गर्नुपर्ने आवश्यकता किन देख्नुभयो र वर्तमानमा कस्ता कठिनाईहरु महशुस गरिरहनु भएको छ
नेपाल आज विश्वको तथ्यांकमा अति गरिव निर्धन मुलुकमा गनिन्छ । २१ औं शताव्दीको यो जमानामा पनि नेपालले १६औं शताव्दीका व्यवहार र प्रचलनवाट प्रताडित हुन वध्य छ । यो अवस्थाले अकल्पनिय अन्याय अत्याचार उत्पिडन नेपाली जनताका नियति वनाईए त्यो नियति मुलुकले शदियौदेखि भोग्दै र व्यहोर्दै आयो । त्यस प्रकारको नियतिवाट मुक्ति पाउनकालागि पटक पटक संघर्षहरु भए तर आजसम्मका सवै संघर्षहरु या त असफलतामा टुगिए यात संझौतामा टुंगिए यात सफल भए पनि तिनलाई संस्थागत गर्न सकिएन ति सवै सफलता र असफलताका अनुभवहरुलाई संष्लेषण गर्दैविश्व क्रान्ति र प्रतिक्रान्त्ािका पनि सफलता र असफलताका अनुभवहरुलाई सं्श्लेशण गर्दै नेपालमा जनयुद्धको थालनी भयो । १० वर्षे जनयुद्धले नेपाली जनताको मुक्तिलाइ सुनिश्चित गरयो । यी सवै उत्पीडन अन्याय अत्याचारको मूल कारण भनेकै एकात्मक सामन्ती हिन्दु राज्य वन्दै आएको र त्यसको नेतृत्व राजतन्त्रले गर्दै आएको परिप्रेक्षमा राजतन्त्रको अन्त विना समान्तवादको समुल नष्ट पनि नहुने र जनताको मुत्तिः पनि संभव नहुने दिनको घाम जतिकै छर्लड छ । यस्तो स्थितिमा अढाईसय वर्ष देखिको सामन्ती राजतन्त्र र सो अनुकुलको राज्यको ढाचा नै नेपाली जनताको मुक्तिको वाधक भन्ने प्रष्ट छ भने अव त्यका विरुद्ध निर्मम हुने र राज्व्यको व्यापक पुनरसंरचना गर्ने वाहेक अर्को विकल्प छदैछैन । यसै मान्यतालाई आत्मसात गरेर नै मुलुलाई सामन्तवादी अत्याचार शोषण र र उत्पिडनवाट मुक्त गर्ने हो भने अढाई सय वर्ष पुरानो राज्य संरचना जसमा राजतन्त्रको वलियो प्रभाव छ त्यो अन्त मुख्य शर्त हो । त्यस पछि नेपालको एकिकरणको कुरा जो पृथ्विी नारायण शाहले गरे भनियो त्यो वास्तवमा एकिकरण थिएन नाक कान काटेर र दवावमा पारेर जवर्जस्त गरिएको एकिकरण थियो त्यसैको परिणाम नेपालको उत्पीडित क्षेत्र सुदुर पश्चिम कर्णाली अंचलले कैल्यै आफूलाई नेपाल भएको अनुभूति गरेनन् मधेशी जनता जसले राज्यको संरचनामा आफनो अधिकार राख्नै नसक्नृे अवस्था आयो राज्इको मुख्य अंग सेना जहा मधेशी जनतालाई मधेशी भएकै नताले वंचित गर्ने अवस्था रहे यस्तै दलित महिला आदिवासी जनजातिहरुको सवालहरु कैलै संवोधन भएनन तसर्थ यी सवै वर्गियक्षेत्रियिलंगियर जातिय सवै समस्याहरुको समाधानका निम्ति मुलुकको पुनरसंरचना जरुरी छ त्यसका निम्ति सामन्ती राजतन्त्रको स्थानमा लोकतापिन्त्तक गणतन्त्रएकात्मक का ठाउमा संघात्मक र सवै वर्ग क्षेत्र लिगं र जातको समानुपातिक प्रतिनिधित्व सुनिश्चित गर्ने गरी राज्यको पुनरसंरचना गर्ने क्रान्तिकारी भूमिसुधारक कार्यक्रम मार्फत भूििम समस्ीयाको हल गर्ने राष्टिय तथा स्वाधिन पूजीको विकास गरी आत्मनिर्भर अर्थतन्त्रको विकास गर्ने जस्ता विषयले मात्र मुलुकका सवै समस्याको समाधान सभव छ भनेर नेकपा माओवादी ले आफनो १० वर्षै जनयुद्ध मार्फत यसको प्रयोग समेत गरिआएको छ जुन वैज्ञानिक छ वस्तुसंगत छ मुलुकका सवै समस्याको समाधान गर्न सक्षम छ यसकारण हामी सो नीतिको दृढतापूर्वक समर्थन गर्छौ । तर यथास्थितिवादी सामन्ती सांच र संस्कृतिका हिमायतिहरु पनि छन् तिनले शदियौदेखि राज्यसत्तामा आफनो पकड जमाएका छन् तिनको प्रभवमा केही आफूलाई परिवर्तनका पक्षधर दावा गर्ने वामपन्थी भन्न रुचाउने दल र तिनका नेतृत्व सत्ता लिप्साको फोहरी आहालमा डुवुल्की मार्दा समस्या देखिएका छन् । अव पहिचान गर्नै ठीक वेला आएको छ वाषैर्ा सम्म कम्युनिष्टको खोल ओडेर परिवर्तनका खटटेवाडेर जनतालाई झुक्याउने दिन अव सकिए त्यसकारण सांचै जनताको। मुत्तिःकोलागि लाग्ने जो कोही पनि राज
क्रान्तिकारी माक्स्रवादी बुद्धिजीवीहरुको एकमात्र संगठन नेपाल राष्ट्रिय बुद्धिजीवी संगठनको चौथो राष्ट्रिय सम्मेलन सम्पन्न भएको छ । मुलुक अग्रगमन र प्रतिगमनको दोसाँधमा उभिएको वेला १० वर्षे जनयुद्धको जग र १२ वुदे समझदारीका आडमा सम्पन्न १९ दिने जनआन्दोलनवाट सिर्जीत नया स्थिति नेकपा माओवादी र सरकार वार्तामा वसेको अवस्थानेपालवाटै विश्वलाई शान्ति अग्रगमन र न्यायको सन्देश दिन लागिरहेका वखत नया विश्वको जन्म हुन लागेको अवस्था संसारभरीका उत्पीडित वर्ग जाति क्षेत्र िलंगले व्यग्रतापूर्ण प्रतिक्षा गरेका वखतहिमालयको काखवाट नया विश्व उदाउन लागिरहेको अवस्थावाट वट अतालिएर साम्राज्यवादी र विस्तारवादी शक्तिहरुले मुलुकलाई यथास्थितिमा वल्झउन तिनका वौद्धिकहरु त्जष्लप तबलप मार्फत हद दर्जाको कोशिश गरिरहेका वखत र संसार भरीकै क्रान्तिकारीहरुले यथास्थितिवादका विरुद्ध जमेर प्रतिरोध गरिरहेका वखत नेपालमा क्रान्तिकारी बुद्धिजीवीहरुको राष्ट्रिय सम्मेलन भव्यतम र उत्साहपूर्ण ढंग वाट सम्पन्न हुने कुराले ठूलो महत्व राखेको छ भन्ने लाग्दछ । साथै यो सम्मेलनको भव्यता र सहभागिता गुण र संख्या दुवै दृष्टिले उल्लेख्य र ऐतिहासिक रहेको छ जसले नेपाली क्रान्तिकारी बुद्धिजीवीहरुका काधमा ठूले दायीत्व पनि थपेकोछ यस मानेमा यो सम्मेलनको भारी महत्व छ ।

सर्वप्रथमत वधाईकानिम्ति हार्दिक धन्यवाद छ निश्चितै रुपमा क्रान्तिकारी बैाद्धिकहरुको गौरवशाली संगठनको अध्यक्ष पदमा निर्वाचित हुने अवसर प्राप्त हुनु र त्यो जिम्मा राष्ट्रिय सम्मेलनले मलाई सुम्पिनु गौरवको विषय त हुदै हो यसले अहम दायित्व पनि सुम्पेकोछ भन्ने अर्थमा मैले लिएको छु । जहासम्म यसको महत्व र उपलव्धीको प्रश्न राख्नु भएको छ संक्षेपमा महत्वका वारेमा माथि वताई सकेको छु । उपलव्धीका वारेमा चर्चा गर्दा यो सम्मेलन लामो समयको अन्तराल पछि विल्कुल भिन्न र नया परिस्थितिमा राजधाीमा सम्पन्न भएको छ । देशैभरीकेा ४ जिल्लाका प्रतिनिधिहरु मौसमको खरावीका कारण यातायात अवरुद्ध भएका कारण र अन्य सानातिना प्राविधिक कारणले अनुपस्थित रहनु परेको अवस्थाले ७१ जिल्लाको प्रतिनिधित्व हुनु झण्डै एक हजार बौद्धिकहरुको जमघट हुनु यसका वाहय र रुप पक्षीय उपलव्धीका हुराहरु हुन भने सम्मेलनको सवैभन्दा महत्वपूर्ण उपलव्धी भनेको नेकपा माओवादीका अध्यक्षजनमुक्ति सेनाका सर्वोच्च कमाण्डर क। प्रचण्ड र नेकपा माओवादीका अर्का वरिष्ठ नेतासंयुक्त क्रान्तिकारी जनपरिषदका अध्यक्ष तथा संगठनकै संस्थापक संयोजक डा बाबुराम भटटराईको उपस्थिति र प्रशिक्षणमूलक सम्वोधनवाट प्रशिक्षित हुन पाउनु हो । २१ औं शताव्दीमा नेपाली भूमिवाट मालेमाको रक्ष विकास र प्रयोग गर्दे नेपाली विशिष्ठतामा क्रान्तिको मोडेल तयार गर्दै विश्वलाई नै अर्को नया विश्व सम्भव छ भन्ने सन्देश दिन लागिरहेको महान आन्दोलनका महानायकहरुवाटै प्रत्यक्ष रुपमा विचार भावना र अनुभूति सुन्नपाउनु यो सम्मेलनको अर्को महत्वको पाटो हो । त्यसै गरी यो सम्मेलनले हिमालयको काखवाट जन्मन लागेको नया विचार सहितको नया विश्वको रक्षा विकास र प्रयोग गर्दै नेपाली जनताको मुक्ति र प्रगतिको मार्गमा विना हिचकिचाहट दृढ विश्वासका साथ लाग्न ठूलो प्रेरणा यो सम्मेलनले दिएको छ । यो सम्मेलनको अर्को उपलव्धी भनेको एउटै सम्मेलनको हलवाट सम्मेलन उदघाटनदेखि समापन सम्म आई पुग्दा व्यक्तिवाद र कमाउ खाउ मोजमस्ती गर भन्ने उपभोक्तवादी नग्न संस्कृतिको विकासले चरमचुली नाघेका वखत सो संस्कृतिलाई चुनौति दिदै आफूलाई सर्वहाराकरण गर्ने प्रतिवद्धताकासाथ देश र जनताप्रतिको त्याग समर्पण र प्रतिवद्धता वाहेक अरु सवै कथित नामधारी सेवा ढोंग हुन भन्ने सावित गर्दै चार दर्जन बौद्धिक व्यक्तित्वहरु संगठनका निम्ति पूर्णकालिन हुन ईच्छुक रहेको घोषणा गुर्न अर्को एउटा बौद्धिक फाटकानिम्ति चुनौति पनि हो र नया संस्कृतिको निर्माण पनि हो जो एउटा नया संस्कृति निर्माणमा कोशे ढू।गा पनि सावित हुनेछ । समग्रमा सम्मेलनले भौतिक नैतिक र वोद्धिक उत्प्रेरणा थपेको छ । यस अर्थमा सम्मेलन भव्य र भारी उपलव्धीपूर्ण रह्यो भन्ने मेरो मात्रै नभएर िसंगो नव निर्वाचित केन्द्रिय समितिको ठहर रहेको छ ।
३। इतिहासको अन्त र विचारको अन्तको हल्ला चलिरहेको बेला नेपाली सर्वहारा आन्दोलनको सहयोगीको रुपमा तपाईहरु नयाँ विचारको विकासमा जुट्नुभएको छ आजको विश्वमा बौद्धिक आन्दोलनका प्रवृत्तिहरु र अन्तरविरोधहरुलाई कसरी विश्लेषण गरिरहनु भएको छ
साम्राज्यवाद र उत्तरआधुनिकतावादले विचारको अन्त र ईतिहासको अन्त भएको जस्ता विभ्रमहरु छर्दै सारा संसारलाई नै विल्कुल अर्थहिन उपभोक्तावादी लक्ष हिन गन्तव्य हिन दिशा तर्फ जसरी डोराउदै छ त्यसका विरुद्ध विचारको अन्त हैन विचारको थप विकास भएको छ विचारको विकासको थालनी सौभाग्यवश नेपालवौ भएको छ र नेपाली जनमुक्ति आन्दोलनकै अगुवाईमा भएको छ भन्ने सन्देश हामीले हाम्रै संगठन मार्फत विश्वलाई दिन पाउनु चानेचुने विषय होईन । यस गौरवपूर्ण घडिमा हामी नेपाली मुक्ति आन्दोलनको सहयोगी एवं सहभागीका रुपमा मालेमावादको रक्षा विकास र प्रयोग गर्दे नेपाली धर्तिमा २१ औं शताव्दीको क्राि तगर्ने विचारको भू्रर्णका रुपमा प्रचण्ड पथ लाई जन्माउदै सो रक्षा र विकास गर्दै विचारकै स्तरमा उठाउने अभियानमा सहभागी हुन पाउदा हामीले गौरव गर्नै पर्छ । यस्तो गौरवपूर्ण क्षणमा उभिएर विश्वमा वौद्धिक आन्दोलनका प्रवृत्तिहरुवारेमा चर्चा गर्दा विश्वका जनमुक्ति आन्दोलनहरु चाहे फ्रान्सेली क्रान्तिको कुरा होस वा वेलायतको राजतन्त्र विरोधी संघर्षका यमयक्रमहोस चिन रुस भियतनाम क्यूवा वा अन्य पूजीवादी र समाजवादी सवैखाले मुक्ति आन्दोलनमा वौद्धिकहरुको भूमिका उल्लेख्य रहेको मात्रै हैन वौद्धिक समुदायको सहभागिता विना कुनै पनि क्रन्ति सम्पनन हुन सक्दैन भन्ने पुष्टि गरिदिएको छ त्यसकारण वौद्धिक आन्दोलनले संसारका सवै जनमुक्ति आन्दोलनमा आफनो सहभागिताको हिस्सेदारीमा गौरव गर्ने हक छ । यति हुदा हुदै पनि बौद्धिक वक्तिहरु कार्यविभाजनका हिसावले मानसिक श्रम गर्ने भएका नाताले र बैद्धिकहरुको क्षमतालाई पूजीवादी साम्राज्यवादी र सामन्तवादीहरुले प्रयोग गर्ने खरिद गर्ने र तिनलाई प्रभाव पार्ने भएका हुनाले बौद्धिकहरु प्रतिकृयावादीको सेवामा वढि देखिनुको दोष आम वौद्धिकहरुले पनि खेप्नु पर्ने अवस्था छ । त्यसकारण बौद्धिक वा अवौद्धिक भनेर र्होइन वर्गिय हिसावले नै सोच्नु पर्ने हुन्छ । बौद्धिक हुनु नै अपराध हैन कि उसले आर्जन गरेको बुद्धि कहा र कसको सेवामा प्रयोग गरेको छ भन्ने कुरालाई नै मुख्य मापदण्ड वनाउनु पर्छ । यसरी हर्दा चाहे चिनको जापानी साम्राज्यवादको आक्रमण र उसको कथित राहत वितरणको वेला होस चाहे रुसको जारशाीको प्रलोभनको अगाडि बौद्धिकहरु कुनै संझौता नगरी दृढतापूर्वक प्रतिरोध गरेर कतिपय ख्यातिप्राप्त प्रोफेसरहरु वरु प्राण त्याग्न तयार भए कथित राहत स्वीकार्न पनि तयार रहेनन् ती उदाहरण मुक्ति आन्दोलनमा बैद्धिकहरुको भूमिका वारे मूल्यंाकन गर्ने महत्वपूर्ण आधारहरु हुन् । बौद्धिकहरुको कामको स्वरुप तिनको क्षमता तिनको विद्धताको समाजमा हुने माग र सोका आधारमा प्रतिकृयावादीहरुले खरिद गर्ने प्रवृत्ति समेतका आधारमा बैाद्धिकहरु स्वयं ढुलमुले वन्ने समाजिक तथा भौतिक परिवेशले विलासी वनाईदिनेमनमा क्रान्त्किो चाहनाका वावजुद पनि भौतिक परिवेशलाई चिरेर अगाडि वढीहाल्ने साहस यदाकदा कमि देखिने समेतका प्रबृत्तिहरु वौद्धिक समुदायमा देखिने गर्दछन् यसका विरुद्ध संघर्ष स्वयं वुद्धिजीवीहरुले नै गर्नु पर्छ । मजदुर बुद्धिजीवी वनने र बुद्धिजीवी मजदुर वनने प्रकृयालाई एकसाथ लगेर मात्रै आन्दोलनको हित हुन्छ भन्ने कुरा पनि वुझन पर्छ । यसरी हेर्दा क्रन्त्ाि विजय र। पराजय मध्यवर्ति तप्का कता लाग्छ भन्ने कुराले नै निर्धारण गर्छ बौद्धिक समुदाय यो वर्गको प्रतिनिधि पात्र हो त्यसो हुदा यो समुदायको आकर्षणमा नै क्रन्त्ािले विजय हासिल गर्छ भन्ने कुरालाई पनि ख्याल गरेर बौद्धिक समुदायको भूमिका र प्रवृतिका वारेमा आंकलन गर्न पर्छ ।
४। विगत अढाई सय वर्षदेखि एकात्मक सामन्ती हिन्दु राज्य बन्दै आएको नेपाललाई संघीय लोकतान्त्रिक गणतन्त्रको रुपमा पूर्नसंरचना गर्नुपर्ने आवश्यकता किन देख्नुभयो र वर्तमानमा कस्ता कठिनाईहरु महशुस गरिरहनु भएको छ
नेपाल आज विश्वको तथ्यांकमा अति गरिव निर्धन मुलुकमा गनिन्छ । २१ औं शताव्दीको यो जमानामा पनि नेपालले १६औं शताव्दीका व्यवहार र प्रचलनवाट प्रताडित हुन वध्य छ । यो अवस्थाले अकल्पनिय अन्याय अत्याचार उत्पिडन नेपाली जनताका नियति वनाईए त्यो नियति मुलुकले शदियौदेखि भोग्दै र व्यहोर्दै आयो । त्यस प्रकारको नियतिवाट मुक्ति पाउनकालागि पटक पटक संघर्षहरु भए तर आजसम्मका सवै संघर्षहरु या त असफलतामा टुगिए यात संझौतामा टुंगिए यात सफल भए पनि तिनलाई संस्थागत गर्न सकिएन ति सवै सफलता र असफलताका अनुभवहरुलाई संष्लेषण गर्दैविश्व क्रान्ति र प्रतिक्रान्त्ािका पनि सफलता र असफलताका अनुभवहरुलाई सं्श्लेशण गर्दै नेपालमा जनयुद्धको थालनी भयो । १० वर्षे जनयुद्धले नेपाली जनताको मुक्तिलाइ सुनिश्चित गरयो । यी सवै उत्पीडन अन्याय अत्याचारको मूल कारण भनेकै एकात्मक सामन्ती हिन्दु राज्य वन्दै आएको र त्यसको नेतृत्व राजतन्त्रले गर्दै आएको परिप्रेक्षमा राजतन्त्रको अन्त विना समान्तवादको समुल नष्ट पनि नहुने र जनताको मुत्तिः पनि संभव नहुने दिनको घाम जतिकै छर्लड छ । यस्तो स्थितिमा अढाईसय वर्ष देखिको सामन्ती राजतन्त्र र सो अनुकुलको राज्यको ढाचा नै नेपाली जनताको मुक्तिको वाधक भन्ने प्रष्ट छ भने अव त्यका विरुद्ध निर्मम हुने र राज्व्यको व्यापक पुनरसंरचना गर्ने वाहेक अर्को विकल्प छदैछैन । यसै मान्यतालाई आत्मसात गरेर नै मुलुलाई सामन्तवादी अत्याचार शोषण र र उत्पिडनवाट मुक्त गर्ने हो भने अढाई सय वर्ष पुरानो राज्य संरचना जसमा राजतन्त्रको वलियो प्रभाव छ त्यो अन्त मुख्य शर्त हो । त्यस पछि नेपालको एकिकरणको कुरा जो पृथ्विी नारायण शाहले गरे भनियो त्यो वास्तवमा एकिकरण थिएन नाक कान काटेर र दवावमा पारेर जवर्जस्त गरिएको एकिकरण थियो त्यसैको परिणाम नेपालको उत्पीडित क्षेत्र सुदुर पश्चिम कर्णाली अंचलले कैल्यै आफूलाई नेपाल भएको अनुभूति गरेनन् मधेशी जनता जसले राज्यको संरचनामा आफनो अधिकार राख्नै नसक्नृे अवस्था आयो राज्इको मुख्य अंग सेना जहा मधेशी जनतालाई मधेशी भएकै नताले वंचित गर्ने अवस्था रहे यस्तै दलित महिला आदिवासी जनजातिहरुको सवालहरु कैलै संवोधन भएनन तसर्थ यी सवै वर्गियक्षेत्रियिलंगियर जातिय सवै समस्याहरुको समाधानका निम्ति मुलुकको पुनरसंरचना जरुरी छ त्यसका निम्ति सामन्ती राजतन्त्रको स्थानमा लोकतापिन्त्तक गणतन्त्रएकात्मक का ठाउमा संघात्मक र सवै वर्ग क्षेत्र लिगं र जातको समानुपातिक प्रतिनिधित्व सुनिश्चित गर्ने गरी राज्यको पुनरसंरचना गर्ने क्रान्तिकारी भूमिसुधारक कार्यक्रम मार्फत भूििम समस्ीयाको हल गर्ने राष्टिय तथा स्वाधिन पूजीको विकास गरी आत्मनिर्भर अर्थतन्त्रको विकास गर्ने जस्ता विषयले मात्र मुलुकका सवै समस्याको समाधान सभव छ भनेर नेकपा माओवादी ले आफनो १० वर्षै जनयुद्ध मार्फत यसको प्रयोग समेत गरिआएको छ जुन वैज्ञानिक छ वस्तुसंगत छ मुलुकका सवै समस्याको समाधान गर्न सक्षम छ यसकारण हामी सो नीतिको दृढतापूर्वक समर्थन गर्छौ । तर यथास्थितिवादी सामन्ती सांच र संस्कृतिका हिमायतिहरु पनि छन् तिनले शदियौदेखि राज्यसत्तामा आफनो पकड जमाएका छन् तिनको प्रभवमा केही आफूलाई परिवर्तनका पक्षधर दावा गर्ने वामपन्थी भन्न रुचाउने दल र तिनका नेतृत्व सत्ता लिप्साको फोहरी आहालमा डुवुल्की मार्दा समस्या देखिएका छन् । अव पहिचान गर्नै ठीक वेला आएको छ वाषैर्ा सम्म कम्युनिष्टको खोल ओडेर परिवर्तनका खटटेवाडेर जनतालाई झुक्याउने दिन अव सकिए त्यसकारण सांचै जनताको। मुत्तिःकोलागि लाग्ने जो कोही पनि राज

Exclusive interview with Intellectuals Maoist Leader Khimlal Devkota on 2006 in franckfort Germany for A World To Win
WPRM: Could you please give your short personal introduction?
Khim.L.D: I am Khimlal Devkota, an Advocate of supremecourt of nepal practised for 15 years after that I joined in peoples liberation movement . I am working in Peoples War movement.Right now I am in negotiation secreteriat, Communist Party of Nepal (Maoist) and I am a central committee member of United Revolutionary People’s Council.Right now member of the interim constitution draft committee.basically I lookafter constution and legal matters.
WPRM: Now you are in Europe, actually what is your main objective and intension to be here? Which goal do you want to achieve with this visit?
Khim.L.D: We in Europe are related with Peoples movement of Nepal, People’s War of Nepal. We want it spread all over the world and we would like to share our experience throughout the world that is our objective. Recently one organisation based in Hamburg invited me as a representative of CPN( Maoist), they wanted to know and share experience regarding future of Nepal in this referance I visited Brussels and now I am here in Germany.it best trips for us because we became succes to exchange our views and experiences to european people.
WPRM: What is your experience and views I mean how are you feeling after visiting different types of people and organisations in Europe?
Khim.L.D:I am feeling so much proud to say that I am really pleased meeting with friends in Eurpe.They are so much interested about People’s War and CPN (Maoist) and on going peace process of Nepal.they are very much interested about Interim Constitution and election of constituent assembly ,restructuring of the state.Let’s say it is my great pleasure and golden opportunity to say somethings to the friends.
WPRM: ….
Khim.L.D: In Nepal the background and the base of 19 days movement was 10 years of People’s war in behind.The main objective of the People’s movement was to establish republican Nepal.
WPRM: In your opinion what were the positive and negative aspects of 19 days People’s movement?
Khim.L.D: In 19 days People’s movement there were positive as well as negative aspects.
First of all I would like to say the positive aspects, most of the people participated in the movement most of the people raised their voice against the monarchy, against the feudalism, against unitary system and they were entirely in favour of republican, democracy, forward looking change and peace. These were the positive aspects not only these, they were asking the People Liberation Army to give them the weapons to fire the monarchy, palace and the feudalism. These were also the positive sides of the nineteen days movement.
Now let’s come to the negative sides, during this nineteen days movement leaders of seven parties alliance should have lead the movement, but it could not happen so.Only few leaders were present in the movement. The movement which could be driven to the republican just
due to the lack of leadership and best commander missed golden oppertunities to establish republican and wipe out monarchy for ever from Nepal. Now we have doubt that seven parties alliance had little bit hidden agreement with the palace.That was also the most negative aspect of the nineteen days movement.
WPRM: Right now how is the relation between seven parties alliance and the monarchy? How is it going on?
Khim.L.D: Right now seven parties alliance , not the all but the major parties within SPA are closely related with the palace, indirectly they are fulfilling the interest of the palace and also they are being the tools used by the palace. So now they are very much distrusted from the people and derecocgnised by the People’s movement.
WPRM: What do you think are the difficulties and obstacles for the democratic process in Nepal?
Khim.L.D. There are so many difficulties, they are as follow first centralism, second feudalism, third autocratic monarchy and fourth the weakness of seven parties alliance unwilling of forward looking change.In seven parties alliance ,we doubt they have little bit of agreement type of behaviour with the palace. These are the main obstacles for the democratic process in Nepal.
WPRM: How is the current living situation of different classes in Nepal and what are their views?
Khim.L.D: Living situation and level of thinking of people in Nepal is very different.There are haves and havesnot people. Some handfull of haves people are having pleasure and experiencing life as the standard of the European people but the majority of people are living in a hard and miserable condition. They are facing hand to mouth problem, they have no medicine, no educaion, no employment etc. That is the inpact of level of thinking of the people. Haves peple are guided by the feudal culture, they want to preserve statusquo some people want reinsteinment of regression. Most of the people are revolutionaries and majority of people think of forward looking change. It has very much gap between haves and haves not like wise regressive and revolutionary thinking.
WPRM: What are the agendas from the democratic, progressive, anti monarchy including Maoist forces?
Khim.L.D: Firstly I think the agendas not only of these forces but the agendas of the nation is to dismantel the uniteraly system, feudal and autocratic monarcy and instead of that establish republican federalism. Secondly in Nepal there are many supressed nationalities, genders inequality and cultural and linguistic inequality, so all these opressed class, opressed genders and opressed nationalitie sould be empower and restructure the state with right to self determination. These are the fundamental agendas that can democratise nation and empower the supress class, genders and other opressed groups. In concrete the agendas are against the monarchy, against the unitery feudal system and instead of that establish full democratic system, republican system and federal system.
WPRM: Which forces are against the democracy, revolution and also against the peace process?
Khim.L.D: There are internal and external forces. Within the country the palace and the army are against the democracy, against the revolution, against the change ,and against the state and people. Externally most of the imperialist forces are against the change, against Nepal and against Nepalese People. They are also very much against democracy, forward looking change and especially against the ongoing peace process.
WPRM: Can you tell in brief what are their role?
Khim.L.D: They are all the time creating hinderness to the peace process. Let’s say seven parties alliance and Maoist already agreed and signd 12 points agreement 8 points agreement and also 5 points agreement but they are all creating hinderness to execution , implemention and translate in practice. When Maoist and seven parties alliance signed the 8 points agreement the very next day imperialist forces, royal palace and royal army were preparing a knot of conspiracy against implementation of 8 points agreement. Not only this they also wanted to disturb the peace process by supplying arms even during the phase of peace process.
WPRM: In coming period of 1 year what do you think is going to happen in Nepal?
Khim.L.D: I think the peace process will go in the positive direction after that interim constitution will be proclaimed, interim legislature will be firmed, parliament will be dissolved, interim Government will declare the election of constituent assembly. Hopefully within one year new constitution will be draft by the constituent assembly and as well as peace process and consolidation of the democracy will be confirm.
WPRM: What are the alternative options, if it does not go in the positive direction as you say above?
Khim.L.D: If positive way will delay within 1 year most of the people will definitely come out in the street once again to protest and resist not only for 19 days but if necessary 29..39.or even 49 days, at that time People’s popular movement will be raised. This people’s power popular movement will compell the regressive forces, status quoist forces return back to the negotiation table and held election of constituent assembly and succeed the peace process and restructuring of the state.
WPRM: Do you think that the people are ready to raise movement again if the peace process goes in negative direction?

WPRM: WPRM in Europe launched different campaigns for the urgent release of Comrade Gaurav , Kiran and others being held in India, China etc. Did you hear about these campaigns in Nepal? If yes what are your views regarding these campaigns?
Khim.L.D: Yes definitely I heard WPRM has done very much good jobs and effective jobs to free Comrade Gaurav, comrade Kiran and other comrades being held in Indian jails, but still now they are in jail . I think WPRM and like WPRM other organisations, instutions and groups must launch another more effective campaigns which can free all our comrades.
WPRM: We have been hearing different mass organisations like youth, student, worker, women are organising their congress one by one these days. Please can you tell what are their intention behind and what are they preparing for?
Khim.L.D: First of all I would say that is their time table routine to held convention. They have to held the national conference, convention and congress, it is the regular duties of all mass organisation. Second thing is that they are very much angry with the regressive and statusquoist forces who are playing role to hinder peace process and not helding the election of constituent assembly. Third thing is that if the regressive forces are not ready to held the election of constituent assembly they have to reorganise popular movement that’s why they are preparing for that too.Also if objective reality demand another type of revolt or revolution they are preparing themselves to become ready to fulfill that.
WPRM: What do you wish people here in Europe should do for success of peace process, demcracy, revolution, abolis of monarchy and especially in favour of Nepal and victory of Nepalese people?
Khim.L.D: First of all success of the peace process in Nepal would be a great message to the imperialist forces of the world, that’s why success of peace process in Nepal is not only for the people of Nepal it would be symbol of victory for the progressive forces of the world. So it becomes the prime duty of people in Europe to play vital role to success the peace process. Second thing progressive people in Europe with ideas of change have to launch more effective campaigns to crush all the hurdles created by the imperialist forces to hamper the ongoing peace process in Nepal. WPRM: Now you are in Europe, actually what is your main objective and intension to be here? Which goal do you want to achieve with this visit?
Khim.L.D: We in Europe are related with Peoples movement of Nepal, People’s War of Nepal. We want it spread all over the world and we would like to share our experience throughout the world that is our objective. Recently one organisation based in Hamburg invited me as a representative of CPN( Maoist), they wanted to know and share experience regarding future of Nepal in this referance I visited Brussels and now I am here in Germany.it best trips for us because we became succes to exchange our views and experiences to european people.
WPRM: What is your experience and views I mean how are you feeling after visiting different types of people and organisations in Europe?
Khim.L.D:I am feeling so much proud to say that I am really pleased meeting with friends in Eurpe.They are so much interested about People’s War and CPN (Maoist) and on going peace process of Nepal.they are very much interested about Interim Constitution and election of constituent assembly ,restructuring of the state.Let’s say it is my great pleasure and golden opportunity to say somethings to the friends.

Khim.L.D: In Nepal the background and the base of 19 days movement was 10 years of People’s war in behind.The main objective of the People’s movement was to establish republican Nepal.
WPRM: In your opinion what were the positive and negative aspects of 19 days People’s movement?
Khim.L.D: In 19 days People’s movement there were positive as well as negative aspects.
First of all I would like to say the positive aspects, most of the people participated in the movement most of the people raised their voice against the monarchy, against the feudalism, against unitary system and they were entirely in favour of republican, democracy, forward looking change and peace. These were the positive aspects not only these, they were asking the People Liberation Army to give them the weapons to fire the monarchy, palace and the feudalism. These were also the positive sides of the nineteen days movement.
Now let’s come to the negative sides, during this nineteen days movement leaders of seven parties alliance should have lead the movement, but it could not happen so.Only few leaders were present in the movement. The movement which could be driven to the republican just
due to the lack of leadership and best commander missed golden oppertunities to establish republican and wipe out monarchy for ever from Nepal. Now we have doubt that seven parties alliance had little bit hidden agreement with the palace.That was also the most negative aspect of the nineteen days movement.
WPRM: Right now how is the relation between seven parties alliance and the monarchy? How is it going on?
Khim.L.D: Right now seven parties alliance , not the all but the major parties within SPA are closely related with the palace, indirectly they are fulfilling the interest of the palace and also they are being the tools used by the palace. So now they are very much distrusted from the people and derecocgnised by the People’s movement.
WPRM: What do you think are the difficulties and obstacles for the democratic process in Nepal?
Khim.L.D. There are so many difficulties, they are as follow first centralism, second feudalism, third autocratic monarchy and fourth the weakness of seven parties alliance unwilling of forward looking change.In seven parties alliance ,we doubt they have little bit of agreement type of behaviour with the palace. These are the main obstacles for the democratic process in Nepal.
WPRM: How is the current living situation of different classes in Nepal and what are their views?
Khim.L.D: Living situation and level of thinking of people in Nepal is very different.There are haves and havesnot people. Some handfull of haves people are having pleasure and experiencing life as the standard of the European people but the majority of people are living in a hard and miserable condition. They are facing hand to mouth problem, they have no medicine, no educaion, no employment etc. That is the inpact of level of thinking of the people. Haves peple are guided by the feudal culture, they want to preserve statusquo some people want reinsteinment of regression. Most of the people are revolutionaries and majority of people think of forward looking change. It has very much gap between haves and haves not like wise regressive and revolutionary thinking.
WPRM: What are the agendas from the democratic, progressive, anti monarchy including Maoist forces?
Khim.L.D: Firstly I think the agendas not only of these forces but the agendas of the nation is to dismantel the uniteraly system, feudal and autocratic monarcy and instead of that establish republican federalism. Secondly in Nepal there are many supressed nationalities, genders inequality and cultural and linguistic inequality, so all these opressed class, opressed genders and opressed nationalitie sould be empower and restructure the state with right to self determination. These are the fundamental agendas that can democratise nation and empower the supress class, genders and other opressed groups. In concrete the agendas are against the monarchy, against the unitery feudal system and instead of that establish full democratic system, republican system and federal system.
WPRM: Which forces are against the democracy, revolution and also against the peace process?
Khim.L.D: There are internal and external forces. Within the country the palace and the army are against the democracy, against the revolution, against the change ,and against the state and people. Externally most of the imperialist forces are against the change, against Nepal and against Nepalese People. They are also very much against democracy, forward looking change and especially against the ongoing peace process.
WPRM: Can you tell in brief what are their role?
Khim.L.D: They are all the time creating hinderness to the peace process. Let’s say seven parties alliance and Maoist already agreed and signd 12 points agreement 8 points agreement and also 5 points agreement but they are all creating hinderness to execution , implemention and translate in practice. When Maoist and seven parties alliance signed the 8 points agreement the very next day imperialist forces, royal palace and royal army were preparing a knot of conspiracy against implementation of 8 points agreement. Not only this they also wanted to disturb the peace process by supplying arms even during the phase of peace process.
WPRM: In coming period of 1 year what do you think is going to happen in Nepal?
Khim.L.D: I think the peace process will go in the positive direction after that interim constitution will be proclaimed, interim legislature will be firmed, parliament will be dissolved, interim Government will declare the election of constituent assembly. Hopefully within one year new constitution will be draft by the constituent assembly and as well as peace process and consolidation of the democracy will be confirm.
WPRM: What are the alternative options, if it does not go in the positive direction as you say above?
Khim.L.D: If positive way will delay within 1 year most of the people will definitely come out in the street once again to protest and resist not only for 19 days but if necessary 29..39.or even 49 days, at that time People’s popular movement will be raised. This people’s power popular movement will compell the regressive forces, status quoist forces return back to the negotiation table and held election of constituent assembly and succeed the peace process and restructuring of the state.
WPRM: Do you think that the people are ready to raise movement again if the peace process goes in negative direction?

वर्तमान परिस्थिति संविधानसभा र गणतन्त्र
संविधानसभा र सो मार्फत लोकतान्त्रिक गणतन्त्र र राज्यको अग्रगामि पुनरसंरचना गर्ने सहमतिमा ऐतिहासिक बाह्र बुदे सहमित भएको थियो । त्यही बाह्र बुदे सहमतिका आधारमा नेपालमा सशस्त्र र निसश्त्र दुवै थरी राजनैतिक शक्तिहरु आन्दोलनमा उत्रिए संवैधानिक राजतन्त्रवादी र जनवादी गणतन्त्रवादी दुवै शक्ति लोकतान्त्रिक गणतन्त्रकालागि तयार भएर त्यो ऐतिहासिक आन्दोलन उठन सकेको थियो । त्यही आन्दोलनको परिणाम अढाईसयवर्षदेखिको राजतन्त्र र साम्राज्यवादीर विस्तारवादी दुवैथरी अन्तराष्ट्रिय शक्तिका वल वुताले कुनैपनिवहानाको राजतन्त्र टिकाउन सकिने अवस्था थिएन सो टिकेन । दश वर्षे जनयुद्धको वलमा तयार भएको १२वुदे सहमतिको आधारमा उठेको आन्दोलनका अगाडि सामन्तवादी साम्राज्यवादी र विस्तारवादी सवै शक्तिहरुले घुडा टेकेको सत्य हो नेपाली जनताको वल त्यतिवेला राम्ररी देखिएको हो ।आज त्यही उपलव्धीलाई संस्थागत गर्न भनी मुलुक अघि वढेको एक वर्ष विति सकेको छ । यो अवधि भित्र पुरानो संविधान पुरानो संसद खारेज भएकाछन् तिनका ठाउमा नया संविधान र अन्तरिम व्यवस्थापिका कृयाशिल छन् जसको मुख्य लक्ष संविधानसभाको निर्वाचन सम्पन्न गर्नेथियो तर आज सम्म पनि हुन सकेको छैन आखिर किन सर्वत्र प्रश्न उठेको छ ।
संविधानसभाको निर्वाचन माओवादीको नारा थियो जुन नारा कुनै वेला प्रजातन्त्रका ठेकेदारहरुकैलागि पनि आतंककारी घोषणा गर्ने मुख्य आधार वनेको थियो टाउकाको मोल तोक्ने अश्त्र वनेको थियो । त्यही संविधानसभा नेपाली आमाका होन हार छोरा छोरी हरुको ज्यान लिने कत्लेआम गर्ने वेपत्ता पार्ने र यातना दिने माध्यम वनेको थियो । त्यही संविधानसभा वार्ता भंग गर्ने कारणवनेको थियो त्यही संविधानसभा दोरम्वा हत्याकाण्ड घटाउने आधार वनेको थियो त्यही संविधान सभा गौर आम नरसंहारको कारण समेतवनेको छ तैपनि संविधानसभा आन्दोलनले राष्ट्रको नारा वन्यो आन्दोलनलाई आत्मसात गर्ननसक्ने नेताहरुकालागि दलहरुकालागि त्यो केवल जप गर्ने भटयाउने र देउसी भैली खेल्ने दुनिया ठग्ने नारा पनि वनिरहेको छ । त्यसैकारण संविधानसभाको निर्वाचन आजसम्म सम्पन्न हुनसकेन र भविश्यमा पनि समपन्न नहुने हो भने यही कारणले सम्पन्न हुनेछैन त्यसकारण सवभन्न्दा पहिला यो कारणको अन्त गर्न पर्छ । त्यो कारणको नेतृत्व अढाई सय वर्षदेखि जनताका विरुद्ध अत्याचार गरी आएको राजतन्त्रले गरेको छ त्यो राजतन्त्रलाई साम्रज्यवादी विस्तारवादी सामन्तवादी र आठ दल भित्रैका राजावादीहरुले सहयोग गरि आएका छन् । त्यसकारण राजावादी र गणतन्त्रवादीहरु वीचको ध्रुविकरण अपरिहार्य छ । गणतन्त्रवादीहरुको उकतावद्ध वलले राजतन्त्रको अन्त र गणतन्त्रको घोषणा गरेर मात्रै संविधानसभाको निर्वाचनलाई सुनश्चित गर्न सकिन्छ ।
यतिवेला राजतन्त्रको अन्त र गणतन्त्रको स्थापना हुने निश्चित भएपछि सवैतिर छरिएर रहेका राजावादीहरु छटपटिएकाछन् । तिनले स्वदेशी विदेशी प्रतिगामी सवैलाई जुटाउन कोशिस गरेकाछन् संगसंगै गणतन्त्रवादीहरुलाई एक्ल्याउने हवाई कल्पना गरिरहेकाछन् त्यसैको परिणाम केही दिन यता माओवादीलाई एक्लयाउन खुलै अर्ति उपदेशहरु दिएका समाचार लेख र सम्पादकीयहरु लेखिन थालेकाछन् माओवादीलाई एक्ल्याउने विगत वाह्र वर्षको के गति भयो त्यही प्रतिगामिहरुको लहै लहैमा लाग्दा सात दलको के गति भयो अन्तमा रत्नपार्कमा अनसन वसिदिने मानिस पनि ज्यालामा खोज्नु पर्ने हालत नेपाली जनताले विसे्रका छैनन् । तैपनि मति गति र प्रवृत्ति कत्ति फेरिन सकेको छैन मसानघाटमा पुगेका सातदललाई पुन रजिवन दिन सफल १२वुदे सहमितलाई लत्याउने काम हुदैछ जनताले निहालेर हेरेकाछन् । फेरि पनि प्रतिगामिहरुकै फेर समात्ने मन्त्र पण्डितहरुवाद दलहरुलाई घोटेर पियाएर पठाईदैछ । अव दलहरुको व्यवहारले भन्नेछ १२वुदा कार्यान्वयनमा वा त्यसलाई ओझेल पार्ने प्रयत्न केमा जोड हुनेछअनि अनुमानलगाउन गाह्रोपर्ने छैन कि दलहरु आफना एजेण्डामा कि अरुका
यहि जेष्ठ २४गते संविधानको दोश्रो संशोधन सदनमा विचाराधिन छ । जसमा जनआन्दोलनको जनादेश संविधानसभाको मिति जेष्ठ वाट मंसिरमा सार्ने प्रस्ताव गरिएकोछ यसैगरी अन्तरिम व्यवस्थापिकावाटै गणतन्त्रको घोषणा गर्ने आवाज प्रस्ताव दर्ता भैरहेका वखत संविधानसभाको निर्वाचन हुन नदिन गंभिर व्यवधान खडा गरेको ठहर भएमा संविधानसभाको निर्वाचन हुनु अगावै पनि व्यवस्थापिकासंसदको तत्काल कायम रहेका सम्पूर्ण सदस्य संख्याको कम्तिमा दुईतिहार्य वहुमतवाट राजसंस्था कायम नरहने गरी प्रस्ताव पारित गर्न सक्नेछ भन्ने व्यहोरा सहितको संशोधन प्रस्ताव गरिएको छ । संग संगै निर्वाचन क्षेत्र निर्धारण आयोगको प्रतिवेदन पुनरावलोकन गर्ने आवश्यकताले सोको संशोधन गरिएकोछ । यसरी संविधानको संशोधन दिर्घकालिन र रणनैतिक सोंचका साथ भन्दा पनि तत्कालिन आवश्यकताका हिसावले गरिएको छ । यसले मुलुकको राजनैतिक निकास भन्दा पनि मुलुकको तत्कालिन आवश्यकता र अपठारोलाई मात्र संवेाधन गर्ने काम गरेको छ भन्न सकिन्छ ।
प्रधानमन्त्रीकानिम्ति विश्वास अविश्वासको मत संवैधानिक नियुत्तिःहरुमा सुनुवाई नगर्ने जस्ता विल्कुल जनताको सरोकार भन्दा पनि पार्टी पदाधिारी र व्यरोक्रयाटसहरुको स्वार्थलाई पूर्ति गर्ने प्राव्धानहरु प्रमुखताकासाथ आउने जनताको सरोकार गणतन्त्र समानुपातिक प्रतिनिधित्व र राज्यको पुनसंरचनाका विषय जस्ता प्रश्नहरुले र आन्दोलनमा उठाईएका गणतन्त्र र समानुपातिक निर्वाचन प्रणाली जस्ता जायज मागहरुले प्राथमिकता नपाउने यस्ता कुराले मुलुक अझै पनि जनताको जनादेशलाई आधार मानेर हैन व्यूरोक्रयाटसहरुकै ईच्छामा चल्छ सामन्त दलाल नोकरशाह हरु कै ईच्छामा चल्छ । विदेशी शक्तिकेन्द्रहरु जनताको ईच्छामा हैन उनै पुराना शासकहरु कै ईच्छा र आकंंक्षामा नै रमाउने गरेको पाईन्छ ।
यो अवस्थाले नेपालीमात्रको स्वाभिमान र स्वतन्त्रतामाथि गंभिर आँच आउने खतरा देखिएको छ नेपाली जनताले आफनो वारेमा आफैलेनिर्णय गर्न नपाउने दुर्भाग्यपूर्ण अवस्थाको अन्त गर्न सके मात्रै सार्वभौमसत्ता सम्पन्न मुलुकको पहिचान पुनस्थापित गर्न सकिनेछ त्यसकालागि सवैभन्दा पहिला नेपाली जनतालाई नै सार्वभौम वनाउन जरुरी छ । त्यसकानिम्ति संविधानसभाको निर्वाचन हुन अनिवार्य छ । संविधानसभाको निर्वाचनको अपरिहार्यतालाई िसंगै मुलुकले आत्मसात गरिसेकेको अवस्थामा पनि शासकहरु र शासन संचालनमा वसेका र तिनलाई हस्तक्षेप गरि राख्ने वैदेशिक शक्ति केन्द्रका ईच्छा र स्वार्थका हिसावले त्यो संविधान सभाको एजेण्डा पछाडि परेको छ । यसकारण संविधानसभाको प्रश्न २००७ सालदेखि थाति रहकेा प्रश्नहो र तयसलाई टुंगोमा पुरयाउने हो भने अव कुनै पनि वाहानामा त्यसलाई पछि पार्न हुदैन झिना मसिना तर्क र कारण अव संविधानसभाको एजेण्डा पछि पर्न हुदैन त्यसै गरी मुलुकलाई संघीय लोकतान्त्रिक गणतन्त्र घोषणा गर्ने कुरा राज्यको अग्रगामि पुनरस्।रुचना गर्ने कुरा समेत लाई प्राथमिकतामा राखिएन भने जनआन्दोलनको जनादेश पुरा गरेको ठहरिने छैन । त्यसले तेश्रो जनआन्दोलन निम्त्याउनेछ । त्यसकालागि हामी आजैदेखि तयार हुन जरुरी छ । माने स्वभाविक रुपमा नमाने आन्दोलनका वलामा जाआन्दोलनका जनादेश पूरा गरी छाडनु पर्नेछ अन्यथा अध्यारा कुनामा षडयन्त्रका तानावाना वुन्ने खतरालाई नै सघाउ पुग्ने छ । त्यस्तो अपराध अव कसैले गर्न हुदैन भन्ने कसम खान पनि पर्नेभएकोछ । तव मात्रै नया नेपालको खाका तयार हुनेछ । अन्यथा फेरि पनि प्रतिगामिहरुले नै राज गनेए छन् । नेपालीहरु रैतिमै सिमसत हुने अवस्था आउनेछ ।

यतिवेला राजतन्त्रको अन्त र गणतन्त्रको स्थापना हुने निश्चित भएपछि सवैतिर छरिएर रहेका राजावादीहरु छटपटिएकाछन् । तिनले स्वदेशी विदेशी प्रतिगामी सवैलाई जुटाउन कोशिस गरेकाछन् संगसंगै गणतन्त्रवादीहरुलाई एक्ल्याउने हवाई कल्पना गरिरहेकाछन् त्यसैको परिणाम केही दिन यता माओवादीलाई एक्लयाउन खुलै अर्ति उपदेशहरु दिएका समाचार लेख र सम्पादकीयहरु लेखिन थालेकाछन् माओवादीलाई एक्ल्याउने विगत वाह्र वर्षको के गति भयो त्यही प्रतिगामिहरुको लहै लहैमा लाग्दा सात दलको के गति भयो अन्तमा रत्नपार्कमा अनसन वसिदिने मानिस पनि ज्यालामा खोज्नु पर्ने हालत नेपाली जनताले विसे्रका छैनन् । तैपनि मति गति र प्रवृत्ति कत्ति फेरिन सकेको छैन मसानघाटमा पुगेका सातदललाई पुन रजिवन दिन सफल १२वुदे सहमितलाई लत्याउने काम हुदैछ जनताले निहालेर हेरेकाछन् । फेरि पनि प्रतिगामिहरुकै फेर समात्ने मन्त्र पण्डितहरुवाद दलहरुलाई घोटेर पियाएर पठाईदैछ । अव दलहरुको व्यवहारले भन्नेछ १२वुदा कार्यान्वयनमा वा त्यसलाई ओझेल पार्ने प्रयत्न केमा जोड हुनेछअनि अनुमानलगाउन गाह्रोपर्ने छैन कि दलहरु आफना एजेण्डामा कि अरुका
यहि जेष्ठ २४गते संविधानको दोश्रो संशोधन सदनमा विचाराधिन छ । जसमा जनआन्दोलनको जनादेश संविधानसभाको मिति जेष्ठ वाट मंसिरमा सार्ने प्रस्ताव गरिएकोछ यसैगरी अन्तरिम व्यवस्थापिकावाटै गणतन्त्रको घोषणा गर्ने आवाज प्रस्ताव दर्ता भैरहेका वखत संविधानसभाको निर्वाचन हुन नदिन गंभिर व्यवधान खडा गरेको ठहर भएमा संविधानसभाको निर्वाचन हुनु अगावै पनि व्यवस्थापिकासंसदको तत्काल कायम रहेका सम्पूर्ण सदस्य संख्याको कम्तिमा दुईतिहार्य वहुमतवाट राजसंस्था कायम नरहने गरी प्रस्ताव पारित गर्न सक्नेछ भन्ने व्यहोरा सहितको संशोधन प्रस्ताव गरिएको छ । संग संगै निर्वाचन क्षेत्र निर्धारण आयोगको प्रतिवेदन पुनरावलोकन गर्ने आवश्यकताले सोको संशोधन गरिएकोछ । यसरी संविधानको संशोधन दिर्घकालिन र रणनैतिक सोंचका साथ भन्दा पनि तत्कालिन आवश्यकताका हिसावले गरिएको छ । यसले मुलुकको राजनैतिक निकास भन्दा पनि मुलुकको तत्कालिन आवश्यकता र अपठारोलाई मात्र संवेाधन गर्ने काम गरेको छ भन्न सकिन्छ ।
प्रधानमन्त्रीकानिम्ति विश्वास अविश्वासको मत संवैधानिक नियुत्तिःहरुमा सुनुवाई नगर्ने जस्ता विल्कुल जनताको सरोकार भन्दा पनि पार्टी पदाधिारी र व्यरोक्रयाटसहरुको स्वार्थलाई पूर्ति गर्ने प्राव्धानहरु प्रमुखताकासाथ आउने जनताको सरोकार गणतन्त्र समानुपातिक प्रतिनिधित्व र राज्यको पुनसंरचनाका विषय जस्ता प्रश्नहरुले र आन्दोलनमा उठाईएका गणतन्त्र र समानुपातिक निर्वाचन प्रणाली जस्ता जायज मागहरुले प्राथमिकता नपाउने यस्ता कुराले मुलुक अझै पनि जनताको जनादेशलाई आधार मानेर हैन व्यूरोक्रयाटसहरुकै ईच्छामा चल्छ सामन्त दलाल नोकरशाह हरु कै ईच्छामा चल्छ । विदेशी शक्तिकेन्द्रहरु जनताको ईच्छामा हैन उनै पुराना शासकहरु कै ईच्छा र आकंंक्षामा नै रमाउने गरेको पाईन्छ ।
यो अवस्थाले नेपालीमात्रको स्वाभिमान र स्वतन्त्रतामाथि गंभिर आँच आउने खतरा देखिएको छ नेपाली जनताले आफनो वारेमा आफैलेनिर्णय गर्न नपाउने दुर्भाग्यपूर्ण अवस्थाको अन्त गर्न सके मात्रै सार्वभौमसत्ता सम्पन्न मुलुकको पहिचान पुनस्थापित गर्न सकिनेछ त्यसकालागि सवैभन्दा पहिला नेपाली जनतालाई नै सार्वभौम वनाउन जरुरी छ । त्यसकानिम्ति संविधानसभाको निर्वाचन हुन अनिवार्य छ । संविधानसभाको निर्वाचनको अपरिहार्यतालाई िसंगै मुलुकले आत्मसात गरिसेकेको अवस्थामा पनि शासकहरु र शासन संचालनमा वसेका र तिनलाई हस्तक्षेप गरि राख्ने वैदेशिक शक्ति केन्द्रका ईच्छा र स्वार्थका हिसावले त्यो संविधान सभाको एजेण्डा पछाडि परेको छ । यसकारण संविधानसभाको प्रश्न २००७ सालदेखि थाति रहकेा प्रश्नहो र तयसलाई टुंगोमा पुरयाउने हो भने अव कुनै पनि वाहानामा त्यसलाई पछि पार्न हुदैन झिना मसिना तर्क र कारण अव संविधानसभाको एजेण्डा पछि पर्न हुदैन त्यसै गरी मुलुकलाई संघीय लोकतान्त्रिक गणतन्त्र घोषणा गर्ने कुरा राज्यको अग्रगामि पुनरस्।रुचना गर्ने कुरा समेत लाई प्राथमिकतामा राखिएन भने जनआन्दोलनको जनादेश पुरा गरेको ठहरिने छैन । त्यसले तेश्रो जनआन्दोलन निम्त्याउनेछ । त्यसकालागि हामी आजैदेखि तयार हुन जरुरी छ । माने स्वभाविक रुपमा नमाने आन्दोलनका वलामा जाआन्दोलनका जनादेश पूरा गरी छाडनु पर्नेछ अन्यथा अध्यारा कुनामा षडयन्त्रका तानावाना वुन्ने खतरालाई नै सघाउ पुग्ने छ । त्यस्तो अपराध अव कसैले गर्न हुदैन भन्ने कसम खान पनि पर्नेभएकोछ । तव मात्रै नया नेपालको खाका तयार हुनेछ । अन्यथा फेरि पनि प्रतिगामिहरुले नै राज गनेए छन् । नेपालीहरु रैतिमै सिमसत हुने अवस्था आउनेछ ।
सार्थक संविधानसभा र भावी संविधानको स्वरुप वारे
पृष्ठभूमिः
संविधानसभा नेपाली समाजको लामो समयको द्धन्दको कारण परिणाम र समाधान सवै वनेर आएको छ । ६० वर्षदेखि थाति रहेको यो प्रश्न आज अत्यन्त चर्चाको शिखरमा छ । राजा राणा र कांग्रसको त्रिपक्षीय संझौताको पनि मुख्य विषय संविधानसभा सात संसदीय दल र नेकपामाओवादी वीच सम्मपन्न १२ वुदे सहमतिको पनि मुख्य विषय संविधानसभा संसदवाी दल र माओवादी वीचको द्धन्दको कारण पनि संविधानसभा राजा र कंग्रस वीचको द्धन्द पनि संविधानसभा दुई दुई पटकका वार्ता भंग हुने कारण पनि संविधानसभा नया नेपालको सिर्जना गर्ने ढोका खोल्ने पनि संविधानसभा पुरानो राज्य यन्त्र उखेल्ने र नया निर्माण गर्ने पनि संविधानसभा राज्यकाृ अग्रगामी पुनरसंरचना गर्ने पनि संविधानसभा समावेशी र समानुपातिकको ग्यारेण्टी गर्ने पनि संविधानसभा सवै हिसवाले संविधानसभा यतिवेला चर्चाको शिखरमा छ । संविधानसभाका सामु धेरै ठूलो दायीत्व पनि छ । यसै महत्वको विषयलाई प्रकाश पार्ने हिसावले चर्चा गर्ने प्रयास यस लेखमा गरिएको छ ।
थालनी ः
संविधानसभा कुनै पनि मुलुककालागि विरलै आयोजना गरिने विधि हो । यो आफैमा साध्य होईन यो साधनमात्र हो तर महत्वपूर्ण साधन हो यो आफैले केही गर्दैन तर यो आयोजना हुन मात्र पनि धेरैकुराको छिनो फानो हुनु हो त्यसकारण यसको महत्व सामान्य साधन हुदा हुदै पनि कतिपय अवस्थामा साध्यको ढोका खोल्ने काम पनि गर्ने गर्दछ त्यसकारण यसको विहंगम महत्वलाई आत्मसात गर्न जरुरी छ ।
संविधानसभाको कठिनाईवारे
नेपालमा संविधानसभा लामो समयको विवाद हो तर पनि किन आयोजना हुदेन अथवा आजभन्दा अगाडि किन भएन प्रश्न गंभिर प्रश्न हो । २००७ सालमा किन भएन २०१५ सालमा संसदीय चुनावमा किन पतन भयो वा गराईयो । २०४६ सालको एतिहासिक भनिएको जनआन्दोलनले पनि किन संविधानसभा आयोजना गर्न सकेन र २०६२।६३को जनआन्दोलनले पनि तुरुन्तै संविधानसभा किन आयोजना गरेन पुनस्र्थापित संसदले पनि किन संविधानसभाकोलागि सिन्को भाच्न सकेन आखिर यिनै प्रश्नहरुको जवाफ भित्र संविधानसभाकेा अर्थ महत्व र कठिनाई सवै निहित छन् । संक्षेपमा भन्न सकिन्छ कि संविधानसभा शासकहरुको ईच्छा विपरितको विषय हो शाषितहरुको चाहना पहिचान र अधिकारको परिचायक वनेको छ । जनताले रैतिवाट नागरिक वन्ने अवसर पनि हो । जो शासकहरु जनतालाई रैतिवाट नागरिक वन्ने अवसरवाट रोक्न चाहन्छन् तिनकालागि संविधानसभा असंभव वनाउनमै समय वित्यो । संविधानसभाले जनतालाई सार्वभौमसत्तासम्पन्न भएको अनूभूति गराउछ यसको व्यवहारिक प्रयोग पनि गराउछ शासकहरु जो जनतालाई मालिक भएको देख्न चाहदैनन उनीहरु कैल्यै संविधानसभाको पक्षधर देखिएनन् । अझ नेपालको सन्दर्भमा त सर्वप्रथम यो सर्वाधिक चर्चाको लोकतान्त्रिक मान्यता हो अर्थात पूजिवादी मान्यताको प्रजातन्त्रको उच्चतम स्वरुप हो आफनो शासन आफै रोज्न पाउने अवस्थाको सिर्जना हुने कुरा अफनो भाग्य आफै निर्धारण गर्न पाउने कुरा कुनै पनि मूल्यमा सर्वाधिक चासोको विषय हो । यसकारण यसको आयोजना आजसम्म हुन सकेन सार्थक संविधानसभाको निम्ति शासक वर्गको स्वार्थमा ठाडै धक्का लाग्ने स्थिति हुदा यो विषय सदेैव शंकाको घेरामा रह्यो ।
यसको वाधक तत्व
लामो समय संविधानसभाका विरुद्धमा माहैाल वनाउने प्रयत्न भयो जव थग्नै नसक्ने भए पछि शसर्त र निशर्त संविधानसभाको वहसमा मुलुक होमियो । राजतन्त्रलाई यथावत राख्ने शर्तमा संविधानसभाको चुनाव आयोजना गर्नकालागि तत्कालिन सत्ताधारीहरु लागी परे र संझाउन थाले आखिर राजाको सामान्य स्थानको कुरा त हो भनेर तर संविधानसभाका पक्षधर हरु सशर्त संविधानसभा हुनै सक्दैन त्यो त संविधानसभाको नाटक हुन्छ सार्थक संविधानसभा हुनै सक्दैन भन्ने जवाफ सहित मुलुकले फेरि युद्ध खेप्न वाध्य भयो । हिजो नै फेल भैसकेको विषय आज अर्को तरिकाले शसर्त संविधानसभाको आयोजना गर्ने प्रयत्नहरु पनि जारी रहे ती प्रयत्नहरु फेल भए पछि राजतन्त्र संविधासभाको मुख्य वाधक तत्वका रुपमा अघि आउन थाल्यो । उसले अनेक हथकण्डाहरु अपनाउन थाल्यो खास गरी जनआन्दोलनका अपराधीहरु र शाही सेनाका अधिकारीहरुको साथमा यो प्रकृयालाई अघि वढाउन थाल्यो । यसै गरी केही लोकतान्त्रिक आन्दोलनका मर्म र मान्यताहरुलाई ईन्कार गर्ने व्यवहार र कार्यशैलीका कारण पनि कठिनाईहरु देखिए । समानुपातिक र समावेशी मुलुक जनआन्दोलनको जनादेश थियो तर पूर्ण समानुपातिक निर्वाचन प्रणालीकालागि केही शक्तिहरु तयार नहुदा यो संविधानसभा सार्थक पनि हुदेन समानवेशी र समानुपातिक पनि हुदैन त्यसकारण यो संविधानसभाको अर्थ छेन भन्दै त्यसका विरुद्ध आन्दोलनहरु हुन थाले । गंभिर विषयलाई आत्मसात गर्न ईन्कार गर्दा यही विषय सविधानसभाको वाधक तत्व वन्न पुग्यो ।
सार्थक संविधानसभाकालागि आधारभूत पक्षहरु
यतिका समय संघर्ष र सन्दर्भ पश्चात आयोजना हुने संविधानसभाको निर्वाचन सार्थक हुन जरुरी छ । त्यो संधिानसभाले मुलुकका सवै समस्याहरुको समाधान गर्ने क्षमता राख्नु पर्दछ समाजका गुनासाहरुलाई संवोधन गर्न सक्नु पर्छ नेपाली समाजको अग्रगामी रुपान्तरण गर्न जरुरी छ र राज्यको अग्रगामी पुनरसंरचना गर्न जरुरी छ । नाममात्रको संधिानसभा नेपाली समाजलाई चाहिएको होईन । नेपाली समाजको द्धन्दलाई रुपान्तरण गर्न सकेन भने त्यो संधिानसभाको महिमा र महत्व आफै न्युनमात्र हैन शुन्यमा परिणत हुनेछ । तसर्थ यो जोखिमलाई समेत मध्यनजर राख्दा मुलभूत रुपमा राजतन्त्र नै आजसम्मको मुख्य वाधक रहेकाले यसको अनत जरुरी छ राजतन्त्र कायमै राखेर संविधानसभाको चुनाव सार्थक चुनाव हुनै सक्दैन किनभने अढाई सय वर्षको राजतन्त्रले कुनै न कुनै रपमा संविधानसभालाई नाकाम वस्तु वनाउने हजार कोशिस गर्नेछ । त्यो चुनावले अपेक्षित उपलव्धी हासिल गर्ने छैन । त्यसकारण यतिवेलाको आवश्यकता भनेको राजतन्त्रको अन्त र सवै जाति क्षेत्र वर्ग िलंगको समानुपातिक प्रतिनिधित्व भएको संविधानसभा वन्ने ग्यारेण्टी देखिनु पर्छ यस पछि मुलुकका सवै स्टेक होल्डरहरुको समुचित सहभागिता शाक्तिको उचित सन्तुलन र जनविश्वास आर्जन गर्ने वातावरण तयार गर्न जरुरी छ । िसंगो मुलुक संविधानसभाकालागि अव कुनै पनि वाधा छेनन भन्ने विश्वासकासाथ लाग्ने वातावरण सिर्जना गर्नेपर्छ अन्यथा भैरहेको विवाद पनि समाधान नहुने उल्टै नया विवादहरु सिर्जना हुने संभावना छ त्यसकारण विवाद समाधान गर्न सक्ने संविधानसभा आजको खांचो हो त्यसतर्फ आधारभूत रुपमा तयारी भयो कि भएन भन्ने वारेमा एकमत हुनै पर्दछ । आधारभूत तयारी पूरा भए पछि सम्पन्न हुने संविधानसभाको निर्वाचनले मात्र मुलुकलाई निकास दिनेछ ।
भावी संधिानको स्वरुप वारे
अन्योलमा आयोजना भएको चुनावमा भावी संविधानको खाका कोर्न सकिदैन र कोरिएको खाका सुनिश्चित पनि हुदैन । आधारभूत शर्त पुरा गरे पछि आयोजना हुने संविधानसभाले भावी संविधानका वारेमा एउटा स्पट चित्र पस्किनै पर्छ । सो काम संविधानसभाको निर्वाचन कै वखत गर्न जरुरी छ । यो परप्रेक्षमा नेपालको भावी संविधानको खाका निश्चित रुपमा निम्न आधारभूत शर्त पूरा गरेको हुन जरुरी छ ।

मुलुक अढाईसय वर्षदेखि राजतन्त्रवाट शासित रहयो जनताले राजतन्त्रलाइृ सेतो हात्ति सरी पाले यतिमा मात्रै सिमित रहेन राजतन्त्रले नेपाली समाज राष्ट्र र जनताका विरुद्ध अपराध पनि गर्न थाल्यो तर कानूनी र संवेधानिक व्यवस्थाले राजपरिवारलाई छुनसकने अवस्था थिएन राष्ट्रको ढुकुटी राजपरिवारको पेवा वन्न पुग्येा मुलुकको उद्योग धन्दा वन्द व्यपार र व्यवसाय सवैमा उसैको वर्चस्व कायम हुन पुग्यो अन्तत दलाल र नोकरशाही पूजिले मुलुकलाई कंगाल वनाई छाडयो तस्करी चोरी लुटपाट र ज्यान मार्ने सम्मका अपराधका वावजुद पनि केही गर्न नसकिने सामाजिक सदभाव नैतिकता र आचरणका विषय पनि त्यतिकै चर्चामा रहे जेहोस राजतन्त्र मुलुककालागि अनावश्यक वदनामीको साधन र राष्ट्रिय अर्थतन्त्रमाथिको लुट र राष्ट्रियता खतरामा पार्न सक्ने हद सम्मको अपराधको पर्याय वनेको राजतन्त्रको अन्त र गणतन्त्रको स्थापना आजको प्रमुख आवश्यकता हो भन्नेक कुरा पुष्ट भएको यस घडिमा भावी संविधान गणतान्त्रिक हुन जरुरी छ त्यो गणतन्त्र रापरिवारको अपराधहरुवाट मुक्त जनताको हित रक्षा गर्ने खालको जनमुखी हुन जरुरी छ कुनै विहारी पाकिस्तानी वा वंगलादेशी प्रकारको हैन । न्पाली समाजका सवै अन्तरविरोधहरुको हल गर्ने क्षमता राख्ने गणतन्त्र आजको आवश्यकता हो । यसकुराको ग्यारेण्टी भावी संविधानले गर्न जरुरी छ ।
एकात्मकको अन्त भै संघात्मक संरचना सहितको संविधान
आजसम्मको नेपाल एकात्मक स्वरुपको रहयो एकल जाती एकल भाषा र धर्मको वाहुल्यता पनि रहयो जसले गर्दा नेपाली समाजको विविधताको अवमूल्यन हुन पुग्यो नेपाली समाजमा भेदभावको अवस्था सिर्जना भयो जसले मेरो देश मेरो संविधान र मेरो संस्था भनने भावना नै जगाउन सकेन त्यसकारण एकिकृत र केन्द्रिकृत शक्ति र श्रोतका कारण आम जनताको असनतुष्टि काफी मात्रामा रहयो जसले द्धन्दको स्वरुप पनि धारण गरयो अव यसको समाधान गर्न संविधानसभाको निर्वाचन आयोजा भैरहेको छ भने त्यसले ती समस्याहरुको संवोधन गर्ने क्षमता राख्न जरुरी छ । त्यसकारण अवको भावी संविधानमा एकात्मक संरचनाको अन्त र संघीय स्वरुपको खाका प्रस्तुत गर्नु पर्छ त्यो केवल खाकामा हैन व्यवहार र मानसिकतामा पनि पविर्तन गर्न जररी छ । आम नेपाली समाज र जनताले त्यो अनुभूत गर्न पाउन पर्छ । भावी संविधानले सो कुराको ग्यारेण्टी गर्न जरुरी छ ।
समानुपातिक प्रतिनिधित्व सुनिश्चित गर्ने संविधान
नेपाली समाजको विशेषता भनेको विविध भाषा विविध जात र संस्कृति हो ती सवैको एकिकृत स्वरुप नेपाल हो । त्यो झलक मुलुकको मूल कानून संविधानमा देखिन जरुरी छ । त्यसकालागि संविधान निर्माण गर्ने सभा संविधानसभाको निर्वाचनमा होस वा भेली राज्यको विधि निर्मात्री संस्था वा सरकार र राज्यका सवै संरचनामा किन नहोस प्रतिनिधित्व सुनिश्चित गर्न जरुरी छ ।
सवै वर्ग जात र क्षेत्र र िलंगको प्रतिनिधित्व गराउन नसक्दा त्यो संविधानले जति अधिकार प्राप्त गर्न पथ्र्यो त्यति प्राप्त गर्न सक्दैन । त्यसकारण संविधान सवैको साभाु सम्पत्ति वन्न जरुरी छ त्यसकालागि समानुपातिक प्रतिनिधित्व सुनिश्चित गर्न अनिवार्य छ । कुनै पनि वहानामा यस विषयलाई ईन्कार गरियो भने समाजमा एकताको भाव दिन नसकने समाजका द्धन्दहरुको समाधान गर्न नसकिने र समाजलाई नया ढंगले रुपान्तरण गर्न पनि कठिन हुने हुन्छ तसर्थ समानुपातिक प्रतिनिधित्व अपरिहार्य छ ।
राज्यको अग्रगामी पुनरसंरचना सुनिश्चित गर्ने संविधान
राज्यको अग्रगामी पुनरसंरचना अपरिहायै वनेको छ । नेपाली समाजको संरचनाका कारण धेरै समस्याहरु सिर्जना भएका छन् धेरै द्धन्दहरु निम्तिएका छन् । ती सवै समस्यहरुको समाधान गर्न यो संरचनावाट संभव छैन यसको संरचनामा व्यापक फेर वदल गर्न जरुरी छ । पुरातनवादी राज्य संरचना र यसका अवयवहरुले अवको विकसित समाजको आवश्यकतालाई धान्न सक्दैन । त्यसकारण यसको व्यापक फेरवदल र पुनरसंरचना अनिवार्य भएको छ । राज्यका खास अंग र संरचनाहरुमा रहेको पुरातनवादी सोंच र चिन्तन वदलिन जरुरी छ । सोच चिन्तन वदलिए पछि तिनको कार्यशैली र जनताप्रति उत्तरदायी हुने अवस्थाको सिर्जना हुने गरी संरचनागत फेरवदल जरुरी छ । सोका निम्ति मुख्य अंग र संयन्त्रहरु निम्न छन् ।
समग्र राज्यको स्वरुमपमा पुनरसंरचना गर्न जरुरी छ तै पनि राज्यका खास खास अंग एवं मेरुदण्डका रुपमा रहेका अंगहरुका वारेमा पुनरसंरचना अत्यन्त छिटो गर्न जरुरी छ । ती संयन्त्रहरु निम्न अनुसार छन् ।
सैन्य संरचनाको पुनरसंरचना
हामी समग्र राज्यको अग्रगामी पुनरसंरचनाका वारेमा चर्चा गरिरहदा राज्यको मेरुदण्ड सैन्य संरचनाको पुनरसंरचना अनिवार्य छ । परम्परागत रुपमा शाही परिवारको नीजि रक्षकका रुपमा विकसित
संविधानसभा नेपाली समाजको लामो समयको द्धन्दको कारण परिणाम र समाधान सवै वनेर आएको छ । ६० वर्षदेखि थाति रहेको यो प्रश्न आज अत्यन्त चर्चाको शिखरमा छ । राजा राणा र कांग्रसको त्रिपक्षीय संझौताको पनि मुख्य विषय संविधानसभा सात संसदीय दल र नेकपामाओवादी वीच सम्मपन्न १२ वुदे सहमतिको पनि मुख्य विषय संविधानसभा संसदवाी दल र माओवादी वीचको द्धन्दको कारण पनि संविधानसभा राजा र कंग्रस वीचको द्धन्द पनि संविधानसभा दुई दुई पटकका वार्ता भंग हुने कारण पनि संविधानसभा नया नेपालको सिर्जना गर्ने ढोका खोल्ने पनि संविधानसभा पुरानो राज्य यन्त्र उखेल्ने र नया निर्माण गर्ने पनि संविधानसभा राज्यकाृ अग्रगामी पुनरसंरचना गर्ने पनि संविधानसभा समावेशी र समानुपातिकको ग्यारेण्टी गर्ने पनि संविधानसभा सवै हिसवाले संविधानसभा यतिवेला चर्चाको शिखरमा छ । संविधानसभाका सामु धेरै ठूलो दायीत्व पनि छ । यसै महत्वको विषयलाई प्रकाश पार्ने हिसावले चर्चा गर्ने प्रयास यस लेखमा गरिएको छ ।
थालनी ः
संविधानसभा कुनै पनि मुलुककालागि विरलै आयोजना गरिने विधि हो । यो आफैमा साध्य होईन यो साधनमात्र हो तर महत्वपूर्ण साधन हो यो आफैले केही गर्दैन तर यो आयोजना हुन मात्र पनि धेरैकुराको छिनो फानो हुनु हो त्यसकारण यसको महत्व सामान्य साधन हुदा हुदै पनि कतिपय अवस्थामा साध्यको ढोका खोल्ने काम पनि गर्ने गर्दछ त्यसकारण यसको विहंगम महत्वलाई आत्मसात गर्न जरुरी छ ।
संविधानसभाको कठिनाईवारे
नेपालमा संविधानसभा लामो समयको विवाद हो तर पनि किन आयोजना हुदेन अथवा आजभन्दा अगाडि किन भएन प्रश्न गंभिर प्रश्न हो । २००७ सालमा किन भएन २०१५ सालमा संसदीय चुनावमा किन पतन भयो वा गराईयो । २०४६ सालको एतिहासिक भनिएको जनआन्दोलनले पनि किन संविधानसभा आयोजना गर्न सकेन र २०६२।६३को जनआन्दोलनले पनि तुरुन्तै संविधानसभा किन आयोजना गरेन पुनस्र्थापित संसदले पनि किन संविधानसभाकोलागि सिन्को भाच्न सकेन आखिर यिनै प्रश्नहरुको जवाफ भित्र संविधानसभाकेा अर्थ महत्व र कठिनाई सवै निहित छन् । संक्षेपमा भन्न सकिन्छ कि संविधानसभा शासकहरुको ईच्छा विपरितको विषय हो शाषितहरुको चाहना पहिचान र अधिकारको परिचायक वनेको छ । जनताले रैतिवाट नागरिक वन्ने अवसर पनि हो । जो शासकहरु जनतालाई रैतिवाट नागरिक वन्ने अवसरवाट रोक्न चाहन्छन् तिनकालागि संविधानसभा असंभव वनाउनमै समय वित्यो । संविधानसभाले जनतालाई सार्वभौमसत्तासम्पन्न भएको अनूभूति गराउछ यसको व्यवहारिक प्रयोग पनि गराउछ शासकहरु जो जनतालाई मालिक भएको देख्न चाहदैनन उनीहरु कैल्यै संविधानसभाको पक्षधर देखिएनन् । अझ नेपालको सन्दर्भमा त सर्वप्रथम यो सर्वाधिक चर्चाको लोकतान्त्रिक मान्यता हो अर्थात पूजिवादी मान्यताको प्रजातन्त्रको उच्चतम स्वरुप हो आफनो शासन आफै रोज्न पाउने अवस्थाको सिर्जना हुने कुरा अफनो भाग्य आफै निर्धारण गर्न पाउने कुरा कुनै पनि मूल्यमा सर्वाधिक चासोको विषय हो । यसकारण यसको आयोजना आजसम्म हुन सकेन सार्थक संविधानसभाको निम्ति शासक वर्गको स्वार्थमा ठाडै धक्का लाग्ने स्थिति हुदा यो विषय सदेैव शंकाको घेरामा रह्यो ।
यसको वाधक तत्व
लामो समय संविधानसभाका विरुद्धमा माहैाल वनाउने प्रयत्न भयो जव थग्नै नसक्ने भए पछि शसर्त र निशर्त संविधानसभाको वहसमा मुलुक होमियो । राजतन्त्रलाई यथावत राख्ने शर्तमा संविधानसभाको चुनाव आयोजना गर्नकालागि तत्कालिन सत्ताधारीहरु लागी परे र संझाउन थाले आखिर राजाको सामान्य स्थानको कुरा त हो भनेर तर संविधानसभाका पक्षधर हरु सशर्त संविधानसभा हुनै सक्दैन त्यो त संविधानसभाको नाटक हुन्छ सार्थक संविधानसभा हुनै सक्दैन भन्ने जवाफ सहित मुलुकले फेरि युद्ध खेप्न वाध्य भयो । हिजो नै फेल भैसकेको विषय आज अर्को तरिकाले शसर्त संविधानसभाको आयोजना गर्ने प्रयत्नहरु पनि जारी रहे ती प्रयत्नहरु फेल भए पछि राजतन्त्र संविधासभाको मुख्य वाधक तत्वका रुपमा अघि आउन थाल्यो । उसले अनेक हथकण्डाहरु अपनाउन थाल्यो खास गरी जनआन्दोलनका अपराधीहरु र शाही सेनाका अधिकारीहरुको साथमा यो प्रकृयालाई अघि वढाउन थाल्यो । यसै गरी केही लोकतान्त्रिक आन्दोलनका मर्म र मान्यताहरुलाई ईन्कार गर्ने व्यवहार र कार्यशैलीका कारण पनि कठिनाईहरु देखिए । समानुपातिक र समावेशी मुलुक जनआन्दोलनको जनादेश थियो तर पूर्ण समानुपातिक निर्वाचन प्रणालीकालागि केही शक्तिहरु तयार नहुदा यो संविधानसभा सार्थक पनि हुदेन समानवेशी र समानुपातिक पनि हुदैन त्यसकारण यो संविधानसभाको अर्थ छेन भन्दै त्यसका विरुद्ध आन्दोलनहरु हुन थाले । गंभिर विषयलाई आत्मसात गर्न ईन्कार गर्दा यही विषय सविधानसभाको वाधक तत्व वन्न पुग्यो ।
सार्थक संविधानसभाकालागि आधारभूत पक्षहरु
यतिका समय संघर्ष र सन्दर्भ पश्चात आयोजना हुने संविधानसभाको निर्वाचन सार्थक हुन जरुरी छ । त्यो संधिानसभाले मुलुकका सवै समस्याहरुको समाधान गर्ने क्षमता राख्नु पर्दछ समाजका गुनासाहरुलाई संवोधन गर्न सक्नु पर्छ नेपाली समाजको अग्रगामी रुपान्तरण गर्न जरुरी छ र राज्यको अग्रगामी पुनरसंरचना गर्न जरुरी छ । नाममात्रको संधिानसभा नेपाली समाजलाई चाहिएको होईन । नेपाली समाजको द्धन्दलाई रुपान्तरण गर्न सकेन भने त्यो संधिानसभाको महिमा र महत्व आफै न्युनमात्र हैन शुन्यमा परिणत हुनेछ । तसर्थ यो जोखिमलाई समेत मध्यनजर राख्दा मुलभूत रुपमा राजतन्त्र नै आजसम्मको मुख्य वाधक रहेकाले यसको अनत जरुरी छ राजतन्त्र कायमै राखेर संविधानसभाको चुनाव सार्थक चुनाव हुनै सक्दैन किनभने अढाई सय वर्षको राजतन्त्रले कुनै न कुनै रपमा संविधानसभालाई नाकाम वस्तु वनाउने हजार कोशिस गर्नेछ । त्यो चुनावले अपेक्षित उपलव्धी हासिल गर्ने छैन । त्यसकारण यतिवेलाको आवश्यकता भनेको राजतन्त्रको अन्त र सवै जाति क्षेत्र वर्ग िलंगको समानुपातिक प्रतिनिधित्व भएको संविधानसभा वन्ने ग्यारेण्टी देखिनु पर्छ यस पछि मुलुकका सवै स्टेक होल्डरहरुको समुचित सहभागिता शाक्तिको उचित सन्तुलन र जनविश्वास आर्जन गर्ने वातावरण तयार गर्न जरुरी छ । िसंगो मुलुक संविधानसभाकालागि अव कुनै पनि वाधा छेनन भन्ने विश्वासकासाथ लाग्ने वातावरण सिर्जना गर्नेपर्छ अन्यथा भैरहेको विवाद पनि समाधान नहुने उल्टै नया विवादहरु सिर्जना हुने संभावना छ त्यसकारण विवाद समाधान गर्न सक्ने संविधानसभा आजको खांचो हो त्यसतर्फ आधारभूत रुपमा तयारी भयो कि भएन भन्ने वारेमा एकमत हुनै पर्दछ । आधारभूत तयारी पूरा भए पछि सम्पन्न हुने संविधानसभाको निर्वाचनले मात्र मुलुकलाई निकास दिनेछ ।
भावी संधिानको स्वरुप वारे
अन्योलमा आयोजना भएको चुनावमा भावी संविधानको खाका कोर्न सकिदैन र कोरिएको खाका सुनिश्चित पनि हुदैन । आधारभूत शर्त पुरा गरे पछि आयोजना हुने संविधानसभाले भावी संविधानका वारेमा एउटा स्पट चित्र पस्किनै पर्छ । सो काम संविधानसभाको निर्वाचन कै वखत गर्न जरुरी छ । यो परप्रेक्षमा नेपालको भावी संविधानको खाका निश्चित रुपमा निम्न आधारभूत शर्त पूरा गरेको हुन जरुरी छ ।

समानुपातिक प्रतिनिधित्व सुनिश्चित गर्ने संविधान

आर्थिक सामाजिक सांस्कृतिक रुपान्तरण सुनिश्चित गर्ने संविधान
राजतन्त्रको उन्मुल भै गणतान्त्रिक संविधान
मुलुक अढाईसय वर्षदेखि राजतन्त्रवाट शासित रहयो जनताले राजतन्त्रलाइृ सेतो हात्ति सरी पाले यतिमा मात्रै सिमित रहेन राजतन्त्रले नेपाली समाज राष्ट्र र जनताका विरुद्ध अपराध पनि गर्न थाल्यो तर कानूनी र संवेधानिक व्यवस्थाले राजपरिवारलाई छुनसकने अवस्था थिएन राष्ट्रको ढुकुटी राजपरिवारको पेवा वन्न पुग्येा मुलुकको उद्योग धन्दा वन्द व्यपार र व्यवसाय सवैमा उसैको वर्चस्व कायम हुन पुग्यो अन्तत दलाल र नोकरशाही पूजिले मुलुकलाई कंगाल वनाई छाडयो तस्करी चोरी लुटपाट र ज्यान मार्ने सम्मका अपराधका वावजुद पनि केही गर्न नसकिने सामाजिक सदभाव नैतिकता र आचरणका विषय पनि त्यतिकै चर्चामा रहे जेहोस राजतन्त्र मुलुककालागि अनावश्यक वदनामीको साधन र राष्ट्रिय अर्थतन्त्रमाथिको लुट र राष्ट्रियता खतरामा पार्न सक्ने हद सम्मको अपराधको पर्याय वनेको राजतन्त्रको अन्त र गणतन्त्रको स्थापना आजको प्रमुख आवश्यकता हो भन्नेक कुरा पुष्ट भएको यस घडिमा भावी संविधान गणतान्त्रिक हुन जरुरी छ त्यो गणतन्त्र रापरिवारको अपराधहरुवाट मुक्त जनताको हित रक्षा गर्ने खालको जनमुखी हुन जरुरी छ कुनै विहारी पाकिस्तानी वा वंगलादेशी प्रकारको हैन । न्पाली समाजका सवै अन्तरविरोधहरुको हल गर्ने क्षमता राख्ने गणतन्त्र आजको आवश्यकता हो । यसकुराको ग्यारेण्टी भावी संविधानले गर्न जरुरी छ ।
एकात्मकको अन्त भै संघात्मक संरचना सहितको संविधान
आजसम्मको नेपाल एकात्मक स्वरुपको रहयो एकल जाती एकल भाषा र धर्मको वाहुल्यता पनि रहयो जसले गर्दा नेपाली समाजको विविधताको अवमूल्यन हुन पुग्यो नेपाली समाजमा भेदभावको अवस्था सिर्जना भयो जसले मेरो देश मेरो संविधान र मेरो संस्था भनने भावना नै जगाउन सकेन त्यसकारण एकिकृत र केन्द्रिकृत शक्ति र श्रोतका कारण आम जनताको असनतुष्टि काफी मात्रामा रहयो जसले द्धन्दको स्वरुप पनि धारण गरयो अव यसको समाधान गर्न संविधानसभाको निर्वाचन आयोजा भैरहेको छ भने त्यसले ती समस्याहरुको संवोधन गर्ने क्षमता राख्न जरुरी छ । त्यसकारण अवको भावी संविधानमा एकात्मक संरचनाको अन्त र संघीय स्वरुपको खाका प्रस्तुत गर्नु पर्छ त्यो केवल खाकामा हैन व्यवहार र मानसिकतामा पनि पविर्तन गर्न जररी छ । आम नेपाली समाज र जनताले त्यो अनुभूत गर्न पाउन पर्छ । भावी संविधानले सो कुराको ग्यारेण्टी गर्न जरुरी छ ।
समानुपातिक प्रतिनिधित्व सुनिश्चित गर्ने संविधान
नेपाली समाजको विशेषता भनेको विविध भाषा विविध जात र संस्कृति हो ती सवैको एकिकृत स्वरुप नेपाल हो । त्यो झलक मुलुकको मूल कानून संविधानमा देखिन जरुरी छ । त्यसकालागि संविधान निर्माण गर्ने सभा संविधानसभाको निर्वाचनमा होस वा भेली राज्यको विधि निर्मात्री संस्था वा सरकार र राज्यका सवै संरचनामा किन नहोस प्रतिनिधित्व सुनिश्चित गर्न जरुरी छ ।
सवै वर्ग जात र क्षेत्र र िलंगको प्रतिनिधित्व गराउन नसक्दा त्यो संविधानले जति अधिकार प्राप्त गर्न पथ्र्यो त्यति प्राप्त गर्न सक्दैन । त्यसकारण संविधान सवैको साभाु सम्पत्ति वन्न जरुरी छ त्यसकालागि समानुपातिक प्रतिनिधित्व सुनिश्चित गर्न अनिवार्य छ । कुनै पनि वहानामा यस विषयलाई ईन्कार गरियो भने समाजमा एकताको भाव दिन नसकने समाजका द्धन्दहरुको समाधान गर्न नसकिने र समाजलाई नया ढंगले रुपान्तरण गर्न पनि कठिन हुने हुन्छ तसर्थ समानुपातिक प्रतिनिधित्व अपरिहार्य छ ।
राज्यको अग्रगामी पुनरसंरचना सुनिश्चित गर्ने संविधान
राज्यको अग्रगामी पुनरसंरचना अपरिहायै वनेको छ । नेपाली समाजको संरचनाका कारण धेरै समस्याहरु सिर्जना भएका छन् धेरै द्धन्दहरु निम्तिएका छन् । ती सवै समस्यहरुको समाधान गर्न यो संरचनावाट संभव छैन यसको संरचनामा व्यापक फेर वदल गर्न जरुरी छ । पुरातनवादी राज्य संरचना र यसका अवयवहरुले अवको विकसित समाजको आवश्यकतालाई धान्न सक्दैन । त्यसकारण यसको व्यापक फेरवदल र पुनरसंरचना अनिवार्य भएको छ । राज्यका खास अंग र संरचनाहरुमा रहेको पुरातनवादी सोंच र चिन्तन वदलिन जरुरी छ । सोच चिन्तन वदलिए पछि तिनको कार्यशैली र जनताप्रति उत्तरदायी हुने अवस्थाको सिर्जना हुने गरी संरचनागत फेरवदल जरुरी छ । सोका निम्ति मुख्य अंग र संयन्त्रहरु निम्न छन् ।

Consolidation of Peace Process in Nepal: Making New Constitution
Focus:
Why we talked about new constitution by constituent assembly it is not mean by we do not have constitution but we wanted to have a constitution by using sovereign power of the people, we wanted to make a constitution by people's representative. In our history there were no single constitution, which had made by people neither they are full sovereign. So new constitution made by constituent assembly was huge slogan for whole conflict period. Reaction on it by so-called establishment proof that how it is pro people. They declared emergency, they declared terrorist, price tag and full swing of security in the cost of Constituent assembly, loss of 15000life was in the cost of it. Now we are in CA going to making new constitution but principal task is logical end of peace process and at the same time making new constitution.
Brief History
Now days we are in peculiar type of transition. It has passed the days of war almost one decade long. Armed conflict agreed to end by socio-economic transformation. Election of Constituent Assembly, abolition of monarchy and republican set up, restructuring of the state inclusive democracy solution of the problems of nationality, region, gender and class were the main objective of the April uprising. From this above-mentioned historical development at present, we are here the democratic republican Nepal now we have a historical responsibility to consolidation of peace process, consolidation of peace process by making new constitution. By new constitution, we have to do restructuring of the state, by restructuring state; we have to focus on socio-economic transformation or economic development. These are the key issue what we have to ensure it through legislation, constitution and daily life of general people.
Why we lack behind in the condition why we became underdeveloped country, why our life standard of the people is miserable? Some of the people wanted to say that Nepal is poor country it has no resources etc but it is not true statement. Infect lack of competent leadership lack of vision and mission.
After election result nation have versioned leadership they can find mission of the nation. It is able to mention in new constitution.
Unique Peace process
Nepalese peace process is unique one. We cannot find this typical modality any others. Election of CA, Republican, state restructuring, Inclusive democracy , federalism all are strange issues raised in the time of war but nobody pay any attention but they were in favored of declaration of terrorist, red corner notice, price tag and emergency . The measure taken to tackle insurgency has failed. It has mentioned socio economic transformation, state restructuring, solution of the problems of the nationality, regional, gender and class, objective was to draft new constitution and integration of army. How it was comprehensive one.
Now we are in transition to translate the principle or philosophy in practice and real life of the general people.
Now we have major task as followings
Logical end of peace process:
How it could be possible, we have to think it. For this purpose we should have Address the cause of conflict. Without any cause, conflict may not take place nor could arms struggle be possible. Therefore, we should have find and address the root cause of conflict.
Main cause of conflict was because of socio-economic disparities exploitation and injustices. If we wants to logical end of peace process we should have transform the present socio economic situation, which is based on feudal culture. Elimination of feudalism and all forms of it we should have launched huge programmed of Socio economic transformation.
Integration of the military
Any type of conflict it becomes always creator of fighting force. We have traditional Army, which was strengthen in this period and simultaneously created PLA as Maoist combatant .Royal Nepal Army and peoples liberation army both of them were fighting forces. Conflict created force should have to be managed. Only the Ideal solution is to integration of the army It could be standardized and make it professional. At the same time professionalized to PLA also is inevitable. Without military integration, conflict cannot minimize.
Reparation to the conflict victim
Conflict was not because of any one individual particular and personal interest but it is a genuine cause. The cause of conflict was creation of particular time and situation. It was huge contradiction of philosophical Ideological and political questions. So compensation is does not make any sense or mean. Instead of compensation, we should have managed it by reparation particularly for conflict victims.
Writing new constitution
Conflict was for ending exploitation, injustice and disparities. It could be managed by writing new constitution. If we failed to write new constitution, conflict may arise by other forms. The historical task is writing new constitution, which can be support to minimize conflict. The constitution is must be a document of Ensuring fundamental rights, Social cultural and economic justice and Ensuring pro people aspiration.
Economic development by ensuring self-reliance and independency, Guaranty of education, health and employment is another aspect of the constitution. Good governance, rapid Economic growth, Harnessing potential of natural resources will be tools for Enlistment of social status of common people.
Balance the foreign policy, Responsible and responsive state, State restructuring and federal structure of the nation by addressing the problems of class nationality gender and region is most important thing. Eradication of all forms of feudalism, Implementation of land reform programmed whatever it is revolutionary or scientific one .These all subjects should have to be incorporate if new constitution.
After all by making new constitution, dress to the cause of conflict and integration of the conflicts created, used, and misused tools, ARMY RNA-NA and PLA, socio-economic transformation could be a means of logical conclusion of the peace process.
Conclusion
Now we are in 21st century. We passed more than one-decade long peculiar history of people's war. We had already used all available solution but final and ultimate solution is negotiation, which is become practical. We cannot undermine the passed history conflict and irregularities. We cannot undermined passed visionless and inefficiency of political leadership. After all, we are here very near to post-conflict situation. We have good experiences of conflict and conflict transformation too. Now it is an appropriate time for us to leap forward the nation. Keeping mind-prejudiced mind can do nothing. So lets start speak truth but not a lie in the name of balance. Lets remained the spirit of various wended and disappeared people. Do not forget that we are the privileged people in the name of depressed and oppressed people. Let us try to understand we are not independent from marginalized and needy people and their aspiration.

Conflict created force should have to be managed. Only the Ideal solution is to integration of the army It could be standardized and make it professional. At the same time professionalized to PLA also is inevitable. Without military integration, conflict cannot minimize.
Reparation to the conflict victim
Conflict was not because of any one individual particular and personal interest but it is a genuine cause. The cause of conflict was creation of particular time and situation. It was huge contradiction of philosophical Ideological and political questions. So compensation is does not make any sense or mean. Instead of compensation, we should have managed it by reparation particularly for conflict victims.
Writing new constitution
Conflict was for ending exploitation, injustice and disparities. It could be managed by writing new constitution. If we failed to write new constitution, conflict may arise by other forms. The historical task is writing new constitution, which can be support to minimize conflict. The constitution is must be a document of Ensuring fundamental rights, Social cultural and economic justice and Ensuring pro people aspiration.

While we discuss a new constitution in the constituent assembly, it does not imply that the country has no constitution at present. Rather, our efforts are aimed at drafting a constitution backed by sovereign power of the people, and through their representatives. Fifteen thousand lives were lost in the process. We in the CA are going to make a new constitution and take the peace process to its logical end.We are in a period of transition. Election of CA, abolition of monarchy, establishing republic, state restructuring, inclusive democracy with the ultimate aim of solving the knotty problems of nationality, regions, gender and class were the main objectives of the 2006 April Uprising.Another important task is restructuring of state by focusing on socio-economic transformation. Absence of visionary political leadership has been the main reason behind most of the country’s ills. But, thankfully, CA polls have thrown up some visionary leaders. Nepal’s peace process is unique, unlike that of any other country.For real transformation in Nepal, we will have to think about addressing the root causes of Maoist conflict. If explored, socio-economic disparities and injustice will emerge as major causes. If we want a logical end to peace process, we have to transform the present socio-economic situation based on feudal culture. Elimination of all forms of feudalism will be at the heart of socio-economic transformation.We have the traditional Nepal Army, which was strengthened in the conflict period, and the PLA. The only effective solution is integration of the two armies. Standardisation and professionalisation of both the armies is essential, without which further conflict cannot be ruled out. The 12-point agreement, Comprehensive Peace Accord and Interim Constitution as well as the later seven-point accord already provide a modality for integration.Conflict was not caused by a single person or institution; its genesis has many reasons. Most probably it was the need of a particular time and situation, the result of colossal tussles between conflicting philosophical, ideological and political stances.It was the Maoist rebellion which started the process of ending exploitation, injustice and disparities. The same task can now be fulfilled by writing a new constitution. If we fail to write a new, truly inclusive constitution, conflict may arise in some otherform in the near future. So let us start facing the facts and tackling them rather than brushing them under the carpet in the name of creating harmony.Let us remember the sacrifices of martyrs, the wounded and the disappeared people. Peoples Republican Maoist and others Communist parties

Now a day the terms "Peoples republican" is a high profile. After the election results of the constituent assembly chairman and Prime Minister Prachanda announced from open theater that, if any political parties hesitate to declared democratic republic than we shall declared peoples republican. At that time chairman prachanda said that if Nepali congress and UML is not ready to do it people will declared peoples republican after that where will be a space for them we can say nothing . This is a clear massage to the people and others political parties that Maoist is not waiting for a long time they are ready to declared peoples republican as soon as possible.
Second time Maoist leader said about peoples republican as a goal of CPN-Maoist. Nepali congress is in opposition. Being in opposition so that any words spoken by Maoist without any clear understanding or quite knowledge, then they are ready to critic it ready to oppose it this is the same things happened which is spread out in the open market.
Why Nepali congress and UML are afraid from peoples republican what is mean by it. First we must know about it.
First of all peoples republican mean by republican for the people by the people and of the people. If it is for the peoples why we should afraid? If any one is in favor of the people, there are no chances to oppose it. Those who are in opposition of peoples republican, they might be in confusion; they have no knowledge of it. If they are in opposition by knowingly it is cleared that they are not in favor of peoples republican instead of peoples republican they wanted to set and established feudal republican bourgeois republican.
Second, we declared republican, but we don't have named it. Whether it is people's republican or Bihari republican we have to make it. Some people wanted to make it Bihari republican. In this favor most of the feudal and comprador burocratic capitalists are being in exercise. Masses of the people are in favor of peoples republican. So it is quite good debate but it should be in fair manner. Especially feudal and comprador and beurocratic capitalists are afraid about it they wanted to save their interest by making republican as Bihari one, instead of peoples republican. They wanted to save from people's democracy.
Third, people's republican is not a strange matters those who are not against the peoples interest, but those who are entirely against the peoples they must be afraid from it.
Fourth the aim of all types of communist party is only peoples republican. The ultimate goal of communist party is peoples republican there is no doubt .Including Maoist they believed on people's republicanism. Even the CPN UML and others communist parties also same in principle. But including UML why they are against it, this is a very important question. The goal of all communist parties is republican. So people should know the fact and they have to take side whatever for or against it. Without having full knowledge taking side is unjustifiable.

Even though communist didn't have reviewed it except The CPN-Maoist. They found that there was some mistake in communist regime which is lack of multiparty competition. So CPN-Maoist accepted that and ready to correct it and easily accepted it in their policy.
If capitalist revolution was completed by Nepali congress and other capitalists parties CPN-Maoist can engage in socialist revolution but capitalist parties are compromised with feudal monarchy so CPN-Maoist thought that, first we have to engaged in capitalist revolution against feudal monarchy and consolidation of democratic republican which is purely capitalism then on the basis of democratic republican it can be established socialism.
In conclusion we don't have any surprising from Maoist version and vision. Maoist vision certainly can be a pro people. First time they may be afire it after a while they would be assimilate in it .Election of constituent assembly,Republican, Federalism ,state restructuring and military intermigration all the issues were the same now turn is peoples republican. It would be happened in its time but now we are in the phase of consolidation of democratic republican. On the basis of it with due time we can have peoples republican.

Now a day the terms "Peoples republican" is a high profile. After the election results of the constituent assembly chairman and Prime Minister Prachanda announced from open theater that, if any political parties hesitate to declared democratic republic than we shall declared peoples republican. At that time chairman prachanda said that if Nepali congress and UML is not ready to do it people will declared peoples republican after that where will be a space for them we can say nothing . This is a clear massage to the people and others political parties that Maoist is not waiting for a long time they are ready to declared peoples republican as soon as possible.
Second time Maoist leader said about peoples republican as a goal of CPN-Maoist. Nepali congress is in opposition. Being in opposition so that any words spoken by Maoist without any clear understanding or quite knowledge, then they are ready to critic it ready to oppose it this is the same things happened which is spread out in the open market.
Why Nepali congress and UML are afraid from peoples republican what is mean by it. First we must know about it.
First of all peoples republican mean by republican for the people by the people and of the people. If it is for the peoples why we should afraid? If any one is in favor of the people, there are no chances to oppose it. Those who are in opposition of peoples republican, they might be in confusion; they have no knowledge of it. If they are in opposition by knowingly it is cleared that they are not in favor of peoples republican instead of peoples republican they wanted to set and established feudal republican bourgeois republican.
Second, we declared republican, but we don't have named it. Whether it is people's republican or Bihari republican we have to make it. Some people wanted to make it Bihari republican. In this favor most of the feudal and comprador burocratic capitalists are being in exercise. Masses of the people are in favor of peoples republican. So it is quite good debate but it should be in fair manner. Especially feudal and comprador and beurocratic capitalists are afraid about it they wanted to save their interest by making republican as Bihari one, instead of peoples republican. They wanted to save from people's democracy.
Third, people's republican is not a strange matters those who are not against the peoples interest, but those who are entirely against the peoples they must be afraid from it.

The ultimate goal of communist party is peoples republican there is no doubt .Including Maoist they believed on people's republicanism. Even the CPN UML and others communist parties also same in principle. But including UML why they are against it, this is a very important question. The goal of all communist parties is republican.
